The day is almost upon me
Wonder what tribunal is really like, I mean they show you this clip on Utube, whilst quite a few ppl on here have commented on how rude and unhelpful they have been, if they wanna behave like that with me then I'm just gonna walk out :mad:
I really don't hold my breath with the appeal, to many doubts, I mean I filled in the ESA50 and it would seem that the DWP told Atos what to look into which is all wrong, report full of rubbish that's been twisted and turned around .....reckon it will either be adjourned and another hearing or thrown out.... Hey but its been 6 months since the original decision, so it might just be a cause of making a new claim on Wednesday

You may-be lucky and get understanding people I appealed went from 0 points to 9 (still not enough). Asked for a statement of reasons so I could take it to the next level, 4 weeks later "we don't know when we will be able to send it!!!"

Not daft at all. ESA is about meeting certain descriptors, which look at whether you may in theory be fit for work, not whether any employer would actually take you on. The tribunal do not set the rules, they simply decide whether they have been applied correctly.
OP, I hope tomorrow goes in your favour, but if it does not, can I suggest you get some proper advice before applying again? Your comments on this and past threads show that you are not at all well prepared for the tribunal.0 -

Yes i know its about meeting the descriptors but whats the point of not meeting those if you will never be able to work!!! (at least the DWP save some money) it has been agreed that I cannot work even for 30mins a day but only get 9 points so have to go on JSA for which I will get nothing because my wife works so money saved and the government can claim look another work shy claimer off the system !!!jacques_chirac wrote: »Not daft at all. galante, have you looked at the descriptors and worked out where you think you will get the points to get the esa ?Play nice :eek: Just because I am paranoid doesn't mean they are not out to get me.:j0

if you dont meet the descriptors. then you dont get the benefit!
as simple as that.
it has nothing to do with emp;oyability.
i am blind and in the WRAG., but noone an name a job that i can do without being able to see/read ( without prior experience)
so i am considered to be capable of 'some form of work' 'aqt some time in the near futur4e'
i want to work... i always worked up until a few years ago.
but it isnt about ability, its about ticking boces0 -
I wanna get back to work, I'm bored with all this...
My last employer ended my 18 year contract over this back issue due to the fact of the length of time I had been off sick. Cant see how the DWP can claim that someone who is in pain most the time, who struggles to sit more than 15 mins a time , stand no more than 10 mins a time and walks under 100 meters before needing to stop can be physically fit for work....generally my mobility is pretty rubbish compared to someone who I consider fit and able
Plus flying high on medication, that makes me tired, lack concentration...ie a feeling of being spaced out...0 -

Sitting down with someone from CAB, welfare rights etc and getting help with the ESA50. But before even doing that you need to make sure that you meet the descriptors - there is little point in applying if you do not.
What evidence have got compiled (or already submitted) for tomorrow? Do you have a statement to read to the panel?0 -

I to would love to do some part time work but if even the Job center say can't help you, it's up to you, what hope is there!!! I worked for over 30 years without ever claiming a penny.if you dont meet the descriptors. then you dont get the benefit!
