And you could always send this to the dca, they must comply or they will be in breach of the oft guidelines they must abide by.

    [My address]

    [Today’s date]

Your reference: [Reference from the debt collection letter]

    Dear Sir / Madam,

I received your letter dated [Date from their letter]

The debt is denied and I will not make any payment in the absence of a county court judgement. Please refer the matter back to your client.

Please do not contact me again. Any further correspondence from you will be considered harassment and will be reported to the appropriate authority.

    Yours faithfully,

  • Quest Debt Recovery need reporting to the OFT for misrepresntation of authority. A few complaints to Trading Standards and the ASA would not go amiss:

Website: claims to have the right to instigate legal proceedings and winding up orders etc when they don't

They do have a current debt recovery licence but offer a tracing service which their licence doesn't cover:

    http://www.oft.gov.uk//OFTwork/credit-licensing/#.UqpTfic0qtA

They claim to have 25 years experience - but the company was only formed in 2012:

    http://companycheck.co.uk/company/08025086/QUEST-DEBT-RECOVERY-LTD/company-summary

And last but not least - they are recruiting former GPB solicitor clients and staff:

  • Thanks Stroma and 4consumerrights!

You send it to quest, if they do not comply they are in breach of various codes of practice. Send both by email and snail mail with a free proof of postage from the post office.

  • Just got a reply from Quest

We have received your email and have been authorised by our client to carry on with the collection of this debt.

If you are unwilling to pay this our client will be taking the account to court where a CCJ could be obtained.

If you are able to pay this today I can offer a full and final discount of £145.00, this will then close the account and stop any futher action from being taken.

Seems as though they can't spell properly either!

Have heard from OFT they say:
'confirm that the business you mention holds a consumer credit licence. We have therefore recorded the details of your complaint, and we will consider this
alongside any other complaints we have received with a view to any consumer credit licensing or other action we may decide to take.'

    What to do now???
  • I would write back and say this:

Thank you for you recent letter

I shall not be contacting you any further with regards to this alleged debt, as you are aware you do not own this alleged but are merely attempting to collect it for your client.

I look forward to receiving Claim papers from your client.

Please do not contact me with regards to this as i shall not respond and in time the account with automatically be returned to your client as you will be unable to collect on it.

    Regards

They are in breach, they must hand this back to their clients, this is in the code of conduct that they must abide by. Simply saying we asked the parking company to continue harassing you is not good enough. I would forward this to the oft saying that this company is not abiding by the rules are treating you unfairly and possibly unlawfully.

  • Stroma, unfortunately a lot of DCA;s refuse to send accounts back to their clients even when advised they must do.

BCW are the worst in this repect and so are AIC

Sorry but could not find my original post!

    Ticket issue 14-10-13
    Notice to keeper 20-11-13
    Appeal 21-11-13

    Thanks

Clearly they are not abiding by the rules, the notice to keeper allows 28 days to appeal, this is utterly stupid as it is not even 28 days until actually tomorrow which is the 20/12/13 , so clearly they are breaching pofa 2012 with this

    Thanks Stroma, HO87 & fisherjim

Have complained to dvla and bpa

Letter to lps all done as suggested and posting tomorrow

    Will let you know

The BPA should be investigating why you are getting debt collection letters when you appealed a day after getting the NTK. You should hear from the BPA and the PPC shortly I would think.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
