Maybe the local council should be encouraged to ask PE the scale of income derived from their presence on the site where no authority was in place for their signage erection.
Also to ask what action PE will be taking in regard to charges received from motorists during this time of unauthorised signage?

Following a similar planning "mistake" by PE over the Dunstable Aldi, I don't think PE paid back any money to motorists they wrongly ticketed . This was the car park where one planning condition was that non-Aldi customers could park there, but PE went ahead anyway and ticketed them.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I have received acomplaint from [ ] relating to the introduction of various signage and CCTV cameras on the forecourts of both retail parks. The signage does not benefit from any deemed consent as defined in the current advertisement regulations nor do the cameras have permitted development rights as they are not attached to a building. Consequently advertisement consent and planning permission are both required. The relevant forms and guidance can befound at;

It has been brought to my attention that parking fines are currently being issued to users of ‘TheRange’ car park, who exceed a certain length of stay. Under the Town andCountry Planning Act 1990, planning permission is required to install CCTVcameras on a commercial building and advertising consent to display the various warning signs in the car park.
I am aware that Barrow Borough Council has not received an application for either the CCTV orthe warning signs, therefore please arrange to apply for retrospective planning permission for both the cameras and the signs, as they are currentlyunauthorised.
The relevant forms to apply for planning permission are available through the Barrow BoroughCouncil website at www.barrowbc.gov.uk under the PlanningSection. There is also the facility to apply online atwww.planningportal.gov.uk.
Alternatively, youcan remove the cameras and signs.

I wrote to you on21st August 2014, regarding the unauthorised cameras and signage in the car park of The Range in Barrow in Furness. I understand that you advised [ ] on 7th October 2014 that Barrow BoroughCouncil should expect to receive a planning application for the above within 2weeks. I note that to date, this application has not been received.
[ ] has tried to contact you by telephone on 21st October, 23rd October,30th October, 4th November and 11th November.Unfortunately you have not been available and she has left messages for you to telephone back.
Please can you arrange to submit a retrospective planning application for the cameras and signs within the next 7 days. Should an application not be received within this time frame, the Council will look to commence enforcement action under the Townand Country Planning Act 1990.
Please be aware that anyone who displays an advertisement or knowingly permits someone else to do so, without the consent required, is acting illegally. It is then immediately open to the planning authority to bring prosecution in the Magistrates’ Court for an offence under section 224 of the Town and CountyPlanning Act 1990.
As you can appreciate this is a course of action that the Council do not wish to take,however the matter now rests with you.

So, as you can see ParkingEye just couldn't be bothered to shift themselves to comply with the law. When they threaten to sue you try starting your reply with

If they are suing you ask their Solicitor if he/she would like to advise the court that they have brought the proceedings as a result of their criminal conduct. After all that Solicitor does have a certain duty to the Court to advise it of relevant matters

On what can be done legally.
Just be aware that District judges at county courts appear to be "starstuck" with parking eye at the moment and are making some very bizzare decision and ignoring case law.
I would not be surprised to see them with an autograph book.
Hence why you take the POPLA route and ignore any "they can do this that and the other posts"I do Contracts, all day every day.0 -
