Failed 'appeal'... for parking in my own space at home?! Advice please?

  • Points 2 and 4 are the killers. Point 1 I put in hoping at some point POPLA might actually decide to tackle the issue that leases trump made up rules every time.

    Remove 3 if it doesn't apply.

    My lease allows me "quiet enjoyment" of my demised property.

    Being hassled by a PPC employed by the headlease holder may well be a breach of the terms of your lease. .
    You never know how far you can go until you go too far.

    One last question before I go to POPLA...

    based on this part of TPS's last contact with me...

    You now have a number of options;

    1. Pay the parking charge at the prevailing price of £50.00 within 14 days. Please note after this time the parking charge notice will rise to £90.00.

    2. 2. Make a POPLA- The Independent Appeals Service by completing the accompanying form. Please be advised that if you opt for the independent arbitration of your case, the Parking charge notice will be £90.00.

    3. If you choose to do nothing, we will seek to recover the monies due via our debt recovery procedures and may proceed with court action against you.


    ... do I need to inform them when I appeal to POPLA? Does it matter either way?

    Regarding the idea of whether or not the lease on my flat states anythign regarding the permit, I'll need to check, but I'll certainly be looking. If there's no reference to permits for parking in it, then I'll look at including that detail in my POPLA apeal too.

    No you don't need to tell them - POPLA will deal with that.

    Point one above deals with the lease part.

    Include the signage point anyway, unless it is compliant with BPA Ltd entrance signage.

    This forces the operator to include signage maps and photographs in their POPLA response. If they are stupid enough not to cancel the ticket then you may as well make them work hard.

    But as BrightonAndHove points out, it's worth putting in anyway, on the offchance that one day an assessor rules on that point, thus setting a precedent.

    I agree, I was just about to add that the OP needs to re-think this because obviously EVERY PPC has signs up!:
