In reference to the invoice xxxxx and your letter of .as the keeper of the vehicle, I’ve decided to deal with this myself for now and raise the following points.
I wish to appeal this parking charge on the grounds that the driver and their mother was genuine customers using the facilities and shops a Argos and not realised that any contravention had taken place they are checking for receipts to prove patronage but as you may appreciate they did not realise they would need to keep in case of parking issues in the future as the driver’s mother is registered disabled and holds a current Blue Badges which I attach a copy of
However I must point out that if you do not grant my appeal I would require a POPLA reference as I will appeal to them in the light of the sincere intentions above and would also be asking them to cancel the parking charge notice
In regards to your parking charge I would like to make the following points
1) The charge is not a genuine per-estimate of loss
2) Your signage is inadequate and does not comply with the BPA code of practice
3) You do not have the authority or contract to issue these invoces
As you know POPLA upholds all appeals on the above so you are invited to cancel this invoice now, or to issue a POPLA code so I can take my case to them

I also note that you still have not added anything about the EQUALITY ACT 2010 which covers this disabled person so those additions should be included as the PPC and the landowner/manging agent are liable under that act
therefore you try to scare them off
in theory your appeal is out of time I believe , but appeal anyway, they may reject it as out of time , so you may have to use either that the NTK didnt arrive (if it didnt) or you may decide to reset the clock by naming the driver if that is an option
the point here being that when you make appeals you should do so when its within the time limits, not months later when it may be too late to do anything about it
that does not mean to say that you wont win in court, but it does go against you if a judge asks why you havent appealed it using the correct processes and timescales
this would have been easily won at POPLA
in the meantime, your best course of action is get it cancelled by the landowner/managing agent and this should be pursued asap0 -
Hi. I'm a newbie here. I have a recent Smart Parking PCN issued in Scotland.
I've checked other threads by can't find an answer to this particular point I have. Wonder if any one can help.
I've gone down the appeal route with Smart Parking (poor signage - the only sign is behind a tree!) and as you'd expect they've rejected it.
They got my details from the DVLA but the name they're using isn't quite right. They've made a mistake on the data input. They've written to me using my first and middle names as a first name. So if my name were John Allan Smith, for example, they've written Mr Ja Smith.
I just wonder if this invalidates the whole thing?

Wow - I wonder if PE are starting to see a bit of sense when appeals to them are lining up GPEOL alongside disabled motorist/passenger and the Equality Act, and where the writing is clearly on the wall within the appeal that POPLA is guaranteed to uphold it.
They've just saved themselves £27.

It was Smart Parking who are a pushover when a strong appeal comes in that they would lose at POPLA. Better than PE who have no clue and press on regardless.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
