Tenants leaving without notice

  • OK then, I'll accept that you know better than I. In which case it's unfortunate and a damned inconvenience to both tenant and landlord but not anyone's fault.

    From what the OP has described I believe this is not the reason they have decided to do a bunk.

    indeed they do, had it happen in an old house, horrid mess!!!

  • just to add that the reason the ceiling came down was that they were bouncing a ball against the ceiling!! I can prove this as my FIL lives upstairs and had to complain about the ball bouncing on his floor. I also accept that the ceiling may have been old, but what got me p***ed was that I busted a gut to get it sorted (covered everything with sheets, hoovered up removed all the rubbish and I know for certain that they had had decided to go BEFORE the incident occurred.

    Take a step back buddy, officially they haven't gone anywhere. Let go of the emotions and be professional, serve notice, seek possession.

    No matter their actions, you should act with integrity. If you get angry you may do something silly. Don't go round there, they could be professional tenants. Wait for you to make a mistake and exploit it.
  • I totally agree with most of what's been said here. I am just pointing out that this ALL could have been avoided. When previous tenants moved out they asked if they could leave within the months notice. They had been brilliant tenants, looked after the place and actually did a lot of work themselves. I was more than happy to reduce the final notice period and the rent for the last month. I retained nothing from the deposit, even though I had to re-carpet, redecorate etc. All people have to do is to be reasonable and communicate with me. I am still waiting for their notice even though I know that they moved out last night! I am surprised that the new landlord has not asked me for a reference.

    Who says you were their last landlord... :) they can say what they like really. Don't wait for their notice, serve a s21 today
  • I hear your frustration, but it doesn't really alter anything. If the ceiling fell in, you would have had to repair it regardless of whether the property was tenanted or not as its part of the general maintenance of your property. It did not mean your tenants owed you any extra obligation to give you notice beyond what is written in their contract. Which they ignored anyway. You repairing the ceiling doesn't alter a thing.

    As others have said, take a step back, put your landlord head on rather than the 'outraged human being' head, and do things legally.., for your own protection.

    Steady on! I don't understand how you know anything for certain. Who has told you that they're moving out?

    Why don't you just knock on the door and ask them? Get them to sign a notice saying they're leaving. Maybe you should tell them you'll waive the notice period if they do so. Sounds like the kind of tenants you should be happy to be rid of!

  • Just a heads up really - I rented a flat and moved out a week before handing my notice in. Parents lent me money for a deposit and once I had all my stuff out I could re-paint and clean the carpets much easier.

    I would just call them, ask them if they are moving out. If the answer is that they already have, explain the notice period and that you'll be expecting the rent up until the end of the notice period. Deal with any deductions for repairs once they have actually left.
  • The removal van was a hint! We live in a small area and they are moving just around the corner. As the beds went yesterday and they slept at the new property last night - they have returned to the flat today to finish moving. I fully understand what everyone is saying, but the law states that they a) still hold the tenancy until they give notice to leave and b) I can do nothing until the 14th which is the date on the AST. I believe that once they have left completely, I can go down the abandonment route( after the14th) and get them to sign a notice to that effect.I really don't want to wait another 2 months before going to court - I really want to sort it out quickly and legally.
