And remember, it's not about what happened on the day, you need to challenge their legal right to issue these fake PCNs. Even their own industry dispute resolution body has overturned every single ticket where a PPC has been asked to prove that the charge is a GPEOL (Genuine Pre-Estimate Of Loss) resulting from the parking "contravention".All that is necessary for the triumph of evil is that good men do nothing. ok , some critique for you
loads of spelling errors, I would think your word processor has a spelling checker so please use it , thanks
ie , tresspass , estimade etc
next, no numbered bullet points at the start of the long paragraphs , like in this one https://forums.moneysavingexpert.com/discussion/4816165
this should be at the top of the long explanations so the assessor can easily find them
next , you havent put in everything you appealed on in the soft appeal , specifically about the EQUALITY ACT 2010 so a glaring omission there
here were those major points to consider1) Your ticket breaches the Equality Act 2010, and your BPA Code of Practice, as a valid blue badge was displayed, even though there is no requirement on private land.
2) the amount demanded is not a genuine pre-estimate of loss
3) The signage is not compliant with the BPA Code of Practice, so no contract can be made
4) You do not have authority or a contract to issue these invoices.
good luck, and post your next draft , but copy and paste into notepad first, then copy and paste from notepad onto the forum for checking

Just search for similar POPLA appeals, in the MSE search box I typed "Equality Act Parking" and came up with this
Discrimination under the Equality Act 2010
Having been diagnosed with anxiety and depression and receiving medication and counselling in respect of the same, the appellant is entitled to an extended period of time to make purchasing decisions and complete their shopping. The issuing of this PCN must be considered discrimination under the Equality Act 2010. A Service Provider cannot lawfully just impose a 'blanket policy' like an arbitrary time limit then rely upon complaints like mine, to cancel charges on individual occasions.

Loads of other threads available to copy too, but obviously adapt to your parent's circumstances.
Your POPLA appeal is a winner, on point 1 alone, but always good to add all the legal arguments. All that is necessary for the triumph of evil is that good men do nothing. Edmund Burke Irish orator, philosopher, & politician (1729 - 1797).0 -

certainly looks ok to me, as long as you triple check for any other spelling mistakes etc
you get one chance at this, so best to be as perfect as possible
might be an idea to add that in a recent BPA newsletter to all parking companies, they advised that any parking charges to a BB holder are dropped when made aware of it, due to the EQUALITY ACT 2010 issues0 -
OK one final huge worry.
I sent off the appeal but when the automated reply came through, my appeal reasons showed as one block of text instead of the properly spaced message i had posted here and that i c&p into the website. It looked fine when I put it in.
Is this usual or have i really destroyed my appeal? Should i do a quick resubmit with apologies?0 -
I suppose it depends on if you copied and pasted from here, from notepad , or from word
I always thought you could attach a word document when submitting online ? (or a notepad document ? ) , I also thought you could attach pictures too ?
might be best to send an email to popla with the word doc attached, mentioning what you said and asking them to add your word doc to your popla ref online appeal and ask for a quick email acknowledgement that they are happy with it in one form or the other
or you can print and send mentioning its a paper copy of what you sent online, or do both , as its all the same thing, just make sure your reference code is on anything you send in0 -
On the Make An Appeal section there was a box saying Please tell us your reasons for appealing:
I C&P'd the appeal from here onto there and sent it off. Would it be worth replying to the automated email or should i sent a fresh email to enquiries@popla.org.uk ?0
