Excel Parking Charge at The Walk in Ebbw Vale, Wales

Ahoy,

I'm here looking for advice for my parents who have recently been issued a charge from Excel for £60-100 for going 20mins~ over their time.

My father displays a blue badge when he parks yet has been snapped twice with automated cameras.

I'm looking for any information as to what I can do to help him, if there is any help at all.Paying £120 is a lot of money for them.

I've checked the stickied threads, and although daunting, I'm not 100% sure if there's any case I can present or how exactly to present it.

Any Googled information about this parking centre seems to be at least a year old so I'm also looking for help if there's been recent law/information changes.

If you have questions I shall do my best to answer them.

    Of course they shouldn't have paid the first fake ticket, so ensure they don't pay this one. Do a soft appeal that will get a popla code so they can win there, we win 100% of the time. And make a complaint to Nick Smith the Blaenau Gwent MP for the area, he takes a personal interest of excel in this location

    As the registered keeper of (reg) I'm in receipt of your Notice to Keeper invoice xxxxx, dated xxxxxx. I reject liability to your company so wish to invoke your appeals process on the following points

    1) Your ticket breaches the Equality Act 2010, and your BPA Code of Practice, as a valid blue badge was displayed, even though there is no requirement on private land.
    2) the amount demanded is not a genuine pre-estimate of loss
    3) The signage is not compliant with the BPA Code of Practice, so no contract can be made
    4) You do not have authority or a contract to issue these invoices.

    Attached is a copy of the blue badge, and you are invited to cancel this invoice or supply a popla verification code to appeal to them if you are minded to reject.

    it may be worth reminding your dad to check his blue badge booklet and remind him that in general the badge is issued and valid for the public highway and local authority official BB parking spaces on the public highway

    he will find that there could be many hoops to jump through when it comes to private land, so he must make sure that he tries to read and comply with the signs on any car parks, private , council or whatever, as it differs on almost every one , especially hospitals and council car parks and airports, so a lot different on private land, which is catching out many BB holders who see the space and believe something that may not be true

    these supermarkets may allow him certain times, may allow extra time for arriving and departing as in this case they maybe should have, but they or the PPC`s set out to trap people in so many ways that being a BB holder does not necessarily mean that he wont have to fight these parking charges each and every time, even if he is in the right and if they are breaking the equality act as can be seen in recent cases on here

    so on the public highway and official parking bays on the public highway he should be ok, parking meters on a public highway , single yellow lines with no restriction like loading chevrons etc , should be ok , anywhere else , caveat emptor , assume the worst unless you KNOW its correct

    When your Dad gets a POPLA code please don't let him send a weak appeal about not knowing that BB holders should pay a P&D fee. HE WOULD LOSE!! Simply revisit my NEWBIES sticky thread and click on 'how to win at POPLA' and learn the usual wording which wins every time against Excel.

    Easy, not daunting; a simple copy & paste job, then show us your draft POPLA appeal at that stage like everyone else. We will help you to make it win.

    What a crying shame they sent money to this well known bunch of chancers owned by a fat-cat horsey type (it's Simon Renshaw-Smith whose pockets they have just lined, a rich company owner - Google him!). What on earth made them think this was a real fine seeing as it didn't come from any Authority? Of course it's not a real parking ticket. They have been MUGGED so make sure they don't get mugged again when they get the inevitable rejection letter from Excel.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Sorry to somewhat necromance this thread but my parents have only just recieved a reply from Excel, after emailing them a soft appeal as outlined by MSE user Stroma above.





    I'm not sure I've 100% convinced my parents to proceed with the POPLA form as reading it and the Excel letter has left them with no confidence and they're rather worried that a failed POPLA appeal is going to to cost them £100. Reading the POPLA form myself, i'm not exactly sure of our case and how I'm supposed to successfully continue.

    Any information, advice or reassurance would be dearly appreciated!

    my advice would be to take them to popla and beat them with a suitably worded popla appeal on the usual pointers

    you can find examples of winning popla appeals in the NEWBIES - READ THIS FIRST sticky thread at the top of the forum, also by using the forum search tool in the green banner and using words that find similar threads to yours, possibly even on the same car park

    Ignore all of the nonsense sent to you by Excel, the only thing they are interested in is extracting money from you.

    You now have a POPLA code, submit a POPLA appeal following the forum guidance and you will have 100% chance of success.

    All you have to do is follow the guidance to get this ticket cancelled, you will pay £0.

    Thanks very much for that link. Would you suggest i C&P the template in its entirety? Is it all applicable to my PCN and their rejection reply?

    I do have a POPLA verification code attached to the POPLA forms on the Excel reply. Do I just pop this code straight into the POPLA website? Once i input the code would i be whisked straight to an appeal form? I only ask so i can be ready with my template.

    no , you receive a sheet of paper with a popla code on it (a verification number)

    you can either use the form , attach a printout of your appeal to that form and post to popla, OR you can attach a copy of your appeal form to the popla website once you have input your verification code, the online form is similar to the printed version but your appeal needs preparing on word or notepad first , if attaching online then perhaps word is best

    so prepare the appeal in word , copy to notepad , then copy the notepad one to here if posting on here for checking (to avoid formatting issues), making sure no personal info has been posted, like reg numbers, ref codes etc

    Perhaps as a starting point, but not as YOUR appeal - you'd need to adjust it to suit your (parents') circumstances.

    As said above, create YOUR appeal then post it here for critique (with personal/identifiable info redacted).

    you need to adapt it and tailor it to your own circumstances (ie:- do some of the work yourself,)

    check other similar appeals to any PPC and use what is relevant in your case

    there is "no one template fits all" scenario

    find what has worked for others in similar circumstances at various car parks, then choose the best bits and use them in yours
