OK then read some of my other posts above and click on other threads given write to UKPC as per post 7 above changing the paragraph in red to read:
Firstly the keeper would like to point out that your notice to keeper was incorrect as there was no windscreen notice to driver provided on the day of the alleged parking breach.
Make that amendment and send to UKPC so then when they reply with a POPLA code we can appeal there.
Have you any photographs of where you parked that day or can you go back and take some?
Also take note of the other questions asked above - how do you know it was prohibited parking etc. If there was inadequate signage.

If the Ntk arrived 8 days after the event (28 Nov), yet the NtK is claiming a NtD (Notice to Driver - windscreen ticket) was issued, then the NtK was way too early. Therefore it's a non-compliant NtK?
(Where a NtD is issued, the NtK must arrive between days 29 and 56 after the event. Day 1 is the day after the event).0 -
Lubo now I'm really confused in post 4 you state the parking event was the 13th November and the NtK arrived 8 days later - Then above you say it was the 20th November????
Which one is correct?????0 -
I read Nov 13 as meaning November 2013.0

I did go and get some photographs and that is why I know of the signage.
There are signs next to other spaces in the area as mentioned previously, it is just they were not seen at the time by the driver or when driving into the area.
On approach you see nothing unusual. Trollies for goods deliveries and about 10m gap before some bollards and parking spaces. There is no clear signage on the first space "Parking with passenger door facing the building and the road on the drivers side" 4 spaces long. It comprises a couple of shutter doors, then the 1st Sign at the end of the 2nd space on left wall and one at the end of all the spaces facing the windscreens but you would not see this if there were cars in front. The driver could miss the 1st also if there was a car in front or they were not specifically looking for that kind of sign ( it could easily be a loading sign etc). Asda make sure you are aware of their terms and conditions when entering their carpark for example.
It looks as if it is used for various things from Parking to unloading/loading.
The fact is the driver and passenger did not stop for long and they did not notice any signs, but there are signs and I would definitely notice them now. The PCN is just so extreme in cost for the actual incident.0 -
Forget about mitigating circumstances and trying to justify the whys and wherefores - when it comes to appeals (and especially POPLA) these have no relevance whatsoever. You challenge their fundamental right to place a contractual charge against you (ostensibly for trespass, wherein any charge can ONLY be related to Genuine Pre-Estimate of Loss - GPEoL).
In harsh terms - lose the "victim" mentality.
