Excel at the Peel Centre again!

Hi all,

Just after some advice on what the best way to proceed with challenging a ticket issued by Excel at the Peel Centre, Stockport might be. Have read recent threads and the general advice given, so my plan is to get a POPLA appeal lodged on the basis of the charge not being a genuine pre-estimate of loss.

However, before I do that, I am going to get in touch with Nando's to see if they can do anything as I was eating there at the time but hadn't parked in their reserved parking section - a bit daft I know but I wasn't really thinking about it at the time and assumed parking would be free at the time of the evening I was there.

One other thing I was wondering if anyone can clear up for me - nowhere on the ticket are the words "Notice to Keeper" used - the heading is "Parking Charge Notice". They are asking for driver details, which I am not about to give them, and it states that in the absence of these, they may pursue the Registered Keeper - I thought that was what they were doing by getting details from the DVLA! Should I wait until they issue a proper NtK or just write to them for a POPLA code (assuming I don't have any joy with Nando's)?

    just clarify what you mean by 'a ticket issued by Excel at the Peel Centre'

    if that means windscreen ticket then wait for notice to keeper through the post. If it came through the post then whatever the heading says doesn't matter (for the purposes of what it is) as it is the notice to keeper.

    in that case send off your appeal;

    Dear Scammer,
    give me a POPLA code etc.

    also read the sticky thread NEWBIES by coupon-mad, tells you exactly who to complain to at that car parking site to try and get the charge (PCN) cancelled

    if you havent read the sticky threads yet , then please do so

    this car park is not only notorious , its even been on watchdog and features every week on here. to say it is legendary is putting it mildly !!

    Good strategy about POPLA appeal on GPEOL. You might also ask for a copy of the contract to be supplied. Mainly to see the extent that the PPC can pursue motorists and to get the contract on the table.

    No witness statements, though - see Parking Prankster's recent blog.
  • Thanks for the responses. This was an ANPR incident so no windscreen ticket issued. I just thought the wording of the letter was ambiguous - doesn't make it clear whether they are addressing it to the keeper or the driver (although it obviously has to be the former, as this is the information they got from DVLA).

    Anyway, I did find some useful stuff on writing to the PPC in the first instance, telling them that you need more information from them before deciding how to proceed. Probably won't be forthcoming but at least it sets your stall out. Am going to write to the landowner as well. Will post back with results in due course.

    This forum is a godsend for things like this, I bet a lot of people just pay these "fines" without even thinking about a challenge! These companies shouldn't be allowed to get away with it.

    hope you worded it as the keeper and didnt admit who the driver was (intentionally or unintentionally)

    the letter sounds like you say , an NTK or NTO , as clearly they dont know who the driver is and no PCN was issued

    so now you need to appeal to them with a suitably worded letter which also demands a POPLA code if refused

    BY THE WAY - it is not a FINE , its a parking charge invoice for a perceived contravention of some petty rules designed to make it awkward for genuine shoppers who then get stabbed in the back 10 to 14 days after their patronage on the site like you have been

    they should stick to the P+D machines contributions instead of trying to maximise their profits by scamming legal and genuine shoppers and customers

    also , the KFC saga there is one big joke now
  • Yep, I was calling it a "fine" in a sarcastic manner - they try to make out that that is what it is though!

    Just wondering what the thrust of my complaint to the Peel Centre should be. I know others have been successful with arguments about mis-typed registration numbers etc. In my case, all I can say is that I was a genuine customer who forgot to buy a ticket and I would imagine they might just claim Excel are doing their job correctly.

    Should I mention the GPEOL thing or ask whether Excel have a contract with Peel allowing them to levy fines - or is that kind of stuff better left for the POPLA appeal?

    best bet is remain aloof and dont fall into their gutter with them , you need to keep a handle on the legal terms here if you really want to beat them at their own game

    its not a fine as only the courts can "fine" you
    Only a court can issue a fine. The police and councils can issue penalties (but not fines). Private Parking companies can do neither.

    if you havent got a good reason like shop receipts etc, best to say nothing (the less they know the better) , so appeal as keeper with one of the short versions and say cancel or send popla code

    then you use an appeal like the ones already sent in and appeal on technicalities as you have seen in that thread I linked

    bear in mind that normally mitigation fails and POPLA do not even consider it when reviewing a case, it says so on their website

    No it is not all you can say and you should make NO admissions, this is NOT about what happened! Read the NEWBIES thread near the top and follow the example appeals links.
