Madbid Rip off!!

I was wondering if anyone could help me I am currently still waiting to hear back from Madbid in regards to an Xbox One I purchased on there site 1/11/2013. I asked them on the day of release 22/11/2013 when I would be receiving my purchase, and a few days later they said wait a week from the release to receive the product and that information will be sent to me shortly, a week later with no Xbox or information I contacted them again with no reply as of yet, I was wondering if it is within my rights to ask for a full refund of the buy it now price I paid plus the money I have wasted bidding on the item in the first place? As I believe that this is unacceptable customer service?

It says you can have a refund for the buy it now price plus delivery charges if you have paid for the item but it hasn't been shipped,

It goes on to say in another section that if they cannot supply an item due to supply issues then your bids can be refunded, but I don't know if that applies to me and by refund do they mean give you the bids back to use or refund what you spent on them?

It's been saying waiting for dispatch since the 1/11/2013 and they said allow a week for it to be arranged since the release date which isn't in their terms and conditions.

I know nothing about gaming stuff but surely it's like this-release date plus maximum ten days? You can't ever get it before the release date presumably?
It's approx a week but max ten days, you will have to go by the website, frustrating I'm sure.

Can you confirm that the issue is that you had an expectation that you were going to receive it on release date but you didn't?
