I was hit from behind, but I'm not insured.

Hi guys,

I need some advice as this is a tricky one. I was hit yesterday afternoon just after midday. The guy was pretty hostile and clearly did not want to give me his insurance details. He did offer to have the work done, but this is on the credit worthiness of someone reeking of alcohol. I have everything recorded including his confession, that he was drunk and the violent terminology.

Anyway, I went to police and reported the matter and they gave me a form to fill and bring back with my mot certificate and insurance details. Anyway, I get home only to discover that my car insurance was cancelled at 9:45am that morning meaning I was uninsured at the time of the accident. The insurance woman was extremely nice and very understanding and informed me that I could still claim off his insurance but that they could not do it on my behalf.

She said when I go to the police station again tomorrow, explain the situation and say that you want his insurance details. I should then make a claim against his insurer.

Is this right? I immediately insured my vehicle again as soon as I was aware it had been cancelled due to a payment issue.

Any help would be great,

    You must have had notification that it would be cancelled due to lack of payment plus the plod may well do you for no insurance also as your car was illegal the other cars insurance I doubt will want to know

    Yea but it was via email at 9:45 that morning, there was no seven days notice or even 24 hours notice. Talk about terrible luck! She said it will be fine and that he has still damaged my property.

    I went out believing I was insured, I even have my monthly certificate showing the dates and time I'm covered from and till. 23 November - 23 December, it's with ecar and is a rolling insurance policy which is renewed each month.

    I also have the email which was the only notification I received, showing the date and time.

    They can not cancel your insurance via E_Mail.
    Make a full complaint to the insurer immediately that they have failed in the statutory duty to serve a correct notice of cancellation by post giving 7 days served notice from postmark.
    That you require them to re-instate the insurance immediately as their actions have placed you in danger of prosecution.
    That if they prefer not to take the complaint any further please issue a deadlock notice so the matter can be taken to the FOS.
    Date it : served notice of official compliant and post, NO E_MAIL and obtain a certificate of postage, you must be able to prove you posted it.

    Keep your insurance certificate as they have failed to serve a correct notice of cancellation.

    Really, well that's some good news at least. I did think it was odd because there I am out driving my vehicle believing I'm insured.

    Keep the certificate and produce this at the police station, the FOS will crucify them for this is they are stubbon enough to let it get that far.

    Next time you are hit by someone reeking of alcohol do not enter into conversation with the person. Immediately call the police and they'll come out straight away do a breath test and if over arrest them and take them back to the station for an evidential breath test.
