EXCEL parking charge

i recieved a parking charge notice saying i owe them £100 as i have ignored there first notice this is the first letter i have received and havnt ignored anything YET. i do not want to pay this as when i did park in the stockport peel centre car park about two months ago several of the machines were out of order around me at least 4 with binbags around them an tape, i went last week and one of these is still out of order, i reckon i was about 10 minutes over the 20 minutes free and didnt pay for a ticket as they were out of order, i looked in other cars and none of them had a ticket although i do understand that that can not be my reason for not paying that noone else had a ticket as that wont get me anywhere. is there anything i can do or shall i just pay?

    just read the newbies sticky thread at the top of the forum and also search the forum for numerous examples of similar complaints , especially for the Peel Centre stockport

    you are not the first and wont be the last , so fight it correctly with the correct jargon and you will win

    most of this is already covered in some of the sticky threads

    the search button will also bring up many examples, as will the POPLA successful appeal sticky thread (start at the end and work backwards)

    Be careful about referring to all the 8 stickies, though, as some posts pre-date POPLA 2012 and may be misleading. You will have seen some newbies saying that they followed the advice on here and ignored the PPC and now face court. I suspect they picked up pre-2013 advice.
  • help! i am really not good at anything like this im only young and dont know where to start! do i really have a leg to stand on as i didnt purchase a ticket and went over the time? could they just tell me i should have walked down to near toys r us? i was at the boots and argos end!

    It really doesn't matter what they say. They just want your money.

    If you take your time and slowly read through Coupon-Mad's sticky it WILL all make sense.

    Was this a "ticket" on your windscreen or a letter through the post? What are the dates of everything you have received?
  • no this was a letter through the post, the issue date of it is 22/11/2013
    it says the alleged contravention was documented and recorded at the above carpark on the 16/09/2013 and a parking charge notice was either affixed to the vehicle or issued through the post and remains unpaid. the reason for the contravention was: parked without displaying abvalid ticket/permit
    i havnt recieved any letter before this one im guessing it got lost somewhere with post although i wouldnt have payed it anyway.

    you should not ignore these letters as they wont go away unless you challenge them properly

    you need to appeal to them on the basis you never saw any PCN on the car itself on the day in question, also that you have not received the NTK within 14 days either and that this new letter is the first time you as keeper are aware of it

    tell them you wish to appeal the parking charge on the following grounds with something similar to this too

    Name
    Address

    Dear Excel Parking Ltd

    I am in receipt of your notice to keeper invoice number xxxxxx , (add reg number here), as the keeper of the vehicle I wish to invoke your appeal process on the following points

    1) this is not a genuine pre-estimate of loss
    2) you do not have authority or contract to issue these invoices
    3) your signage is not compliant to the BPA Code of Practice

    So you are invited to cancel this charge, or supply a POPLA verification code if you reject this appeal.

    Please note that the driver never saw any PCN on the car itself on the day in question, thus the letter to which I am responding is the first notification received. The BPA notification guidelines say that any notice to keeper must be received by the keeper within 14 days of the alleged incident - this is not the case here, therefore you will be required to provide proof that a notice to driver (windscreen ticket) was served, otherwise the keeper has no case to answer as your NtK is out of time per Schedule 4 of the Protection of Freedoms Act 2012.

    You may be young but you are going to have to get a grip or you will end up paying lots of money.

    You have a Private Parking ticket and you need to appeal to the Parking Company to get it cancelled.

    But, you MUST READ this thread's opening post https://forums.moneysavingexpert.com/discussion/4816822

    If you don't you wont understand the replies people are going to give you. We can help, but you have to do some work as well. If you are not prepared to, then either pay the charge or wait till the court papers come and see if the judge is in a good mood.

    When you have read coupon-mad's advice, then you need to construct an appeal to the Parking company.

    IT WILL FAIL, but that's not the point. You need to get a POPLA code. (What is POPLA? - read c-m's thread above)

    So, knock up a draft appeal - no more than 4 paragraphs and forget mitigation or Toys R Us - and come back here with it, It should contain appeal points on signage and GPEOL.

    As said, we will help you, but you need to show us you are prepared to put in the effort too.

    Edit Just seen Redx's helpful advice. But do yourself a favour and don't send it till you have read c-m's thread and understood it.
