Thanks for your advice again, but just a quick update for you I have not sent the letter yet as I am struggling with how to word it all. My 'case' is a little more complicated, basically I ordered 4 dresses in total, the first was too small - like really tiny, second too big and I mean huge, the third poor quality (stiff zips, thread hanging out etc). They refunded my first dress as a good will gesture, but will not refund the other two. Thats when I decided to order a 4th dress this time a full priced item with the credit note funds hoping that when I returned it I would receive a full refund for the dress with it being a full priced item how wrong I was.
It just went back into the 'credit funds'. So back to square one, sent them one last email before thinking of compiling a letter which is the next step, stating distance selling like the OP suggested as she had done, got a very stern email back stating they are aware of such laws and they are following them etc, I will not be receiving a refund and that this will be the last correspondance they will be sending me as the matter has been resolved. And are still refusing to give me a telephone number.
Any ideas how I can word the letter, I have had a look at the templates on CAB as the lady forwarded me to email but doesn't really apply with this case of being offered a credit note but no refund. I just feel so frustrated and feel like I just won't get anywhere and they will just ignore my letter!
Hope theres some light at the end of the tunnel...!0 -
Very interesting thank you for your help will Keep you posted to my outcome! Fills me with some hope Aki123 that they said they Would refund let me know if they did. Tomwakefield you have been most helpful x
Hi - just to update you - YES! I got the refund onto my credit card.
I also reported them to Trading Standards, and had a very nice chat with a chap in our local office who said he would be passing it onto their Bolton office to investigate. He thought the 'Free Returns' with nothing on the returns label to say that it was paid seemed wrong, and they would look into it.
The Advertising Standards Agency also got back to me, but said that as the returns label only 'advised' that the parcel should be tracked, there wasn't really a strong enough argument to say that their 'Free Returns' was misleading. Hmm.
Hope this helps.0
