Thank you for the advice. Letter and complaints sent.
  • Its been a while but I have a few updates and a POPLA code as of today. I sent off complaints to the BPA and the DVLA.
BPA are requesting PEs latest correspondence which I will send today, the DVLA have confirmed the practice of delaying POPLA is a one that should not be happening and have sent the below to BPA members saying these constitute as code breaches.

    - Asking the motorist to enter into additional correspondence to obtain a POPLA code.
    - Failing to include a correct and/or valid POPLA Code within the Rejection correspondence.
    - Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection.
    - Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied.

Using supertedgb case and the template I will draft a POPLA appeal. Any other advice would be much appreciated.

    Thanks.

Isn't Supertedgb's case a Motorway Services? If so then the signage wording about the regulations for signs won't be relevant - but it was a humdinger of a POPLA appeal I seem to recall from earlier.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Good News! Appeal accepted on the following grounds via POPLA.

"The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were."

Thanks very much for all of your help. Followed the recommendations and templates suggested above, have definitely worked wonders.

Yet another case of ParkingEye throwing in the towel and not bothering to defend themselves at POPLA.

    Good news indeed !

See Da_Rule - nothing to do with the Ntk being non-compliant at all.
