ParkingEye - Slight Overstay, Customer with no receipts.

Hi,
Without giving to many details I have recently received a parking charge from ParkingEye. I have read through the various threads but have found none on this particular car park.
I sent an appeal to Parking Eye in the 3rd party as I wasn't the driver and also stating the charge was unjustified. I have requested a POPLA code but have yet to receive. I have been sent two letters, one requesting the drivers info and another rejecting the charge being unjustified.
I intend to write to the council as a visit was made to a doctors surgery and we were advised to park here. I also intend to write to the two stores that were visited.
Any advice on approach would be greatly appreciated. After reading the two letters I believe they are for information only and a request for information. There is no clear indication of a rejection anywhere.

Well you can deal with this as the registered keeper, so could write back and say as they have rejected the appeal to send a popla code to you as the registered keeper, or you can pass on the driver details so they can deal with it.
A couple of questions, is this England or Wales ? Did you get the notice to keeper within 14 days ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I have suggested this approach as PPCs are refusing (at first) to send POPLA codes to keepers. Basically, they are getting knocked out of court, so to speak, at POPLA with our appeal points.
I wanted someone to try this sort of appeal so that we could incorporate a version with the initial appeals in future for recalcitrant PPCs.
But the aim is to get the POPLA code, so whatever you think best.0 -

Well I would unless you intend to name the other person. Something like this
Dear parking eye
In reference to the invoice xxxxxx, and your letters of (date). As the registered keeper of the vehicle, I've decided to deal with this myself, and not name the driver as I am entitled to under the Protection of Freedoms Act 2012.
So I wish to once again ask you to forward the popla verification code so an appeal can be made there. The intension is to appeal on the following grounds
1) The charge is not a genuine pre-estimate of loss
2) Your signage is inadequate and does not comply with the bpa Code of Practice
3) You do not have authority or contract to issue these invoices
As you know popla upholds all appeals on the above, so you are invited to cancel this invoice now

Hi,
Sent a mix of the above and have received 2 letters back.
1st: Referencing Schedule 4 of the Protection of Freedoms Act 2012 requesting I supply the name of the driver even after stating I wish to deal with this myself, as suggested above.
2nd: A letter requesting evidence of my visit to the retail park as a patron. I have no evidence to support this as far as receipts or bank statements and from reading previous posts its futile. Cash was used.
A note is that we were advised to park in the retail park by a council / NHS service opposite who I can confirm an appointment with.
After explicitly requesting a POPLA code I have again not received one.
Any help on next approach would be appreciated.

Dear Parking Eye
In reference to your two letters sent to the Registered Keeper dated xx/xx/xx. I have informed your company that this is being handled by the Registered Keeper of the vehicle, this is the legal right to do so under pofa 2012 as you are well aware.
The appeal has been sent, there is nothing further to add to it, you again asking for information is not going to be forwarded to you. So you have two choices either accept the appeal, or reject it and send the popla verification code so an appeal to them can be made.
Your delaying tactics are being reported to the BPA and DVLA, you are in breach of the Code of Practice you supposedly have to follow. No further correspondence will be entered into.

If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
