Yes, you don't HAVE to but I would in fact, as it may get it cancelled. But you don't have to name the driver.
You say something like:
'I am the registered keeper and this is my appeal. Firstly, this PCN breaches the Equality Act 2010 because the driver on this occasion was almost seven months pregnant and as such, is currently slower to shop than normal. Your arbitrary time limit breaches the Equality Act 2010 as it makes no allowance for visitors who share 'protected characteristics'. Pregnancy means the driver is protected under the Act and for you to pursue a charge for an alleged overstay is indirect discrimination - a breach of the law by G24, and by implication, by your principal (your client, the owner/occupier who you are agent for). Making adjustments for protected visitors is an anticipatory, statutory duty on you (and your clients) as service providers. It seems to me you have failed in this regard.
Take formal note: if you do reject this challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, as well as damages for distress caused to myself and to the driver for this illegal harasment. By continuing to pursue me you agree to pay these costs when I prevail at POPLA, since I have already spelt out my case to you at this early stage - and clearly you must cancel; to pursue the charge would be vexatious and would compound the Equality Act breach.
For your information I would also be citing the fact that your charge is not a genuine pre-estimate of loss and would require your contract with the owner/occupier to be submitted to POPLA, along with all evidence of agreement and discussions made regarding your Equality Act duties and adjustments made at this car park. I will also be asking your client for the same information, as I wish to expose your flagrant disregard of Equality law and obvious ignorance of your anticipatory duties, when I submit my official complaint shortly.

We sent a letter to G24 similar to that mentioned above:
Here is the watered down reply we received from them.
"Re PCN XxXxXxXxX
Thank you for your mail.
After consideration of the information provided by you, your dispute has been unsuccesful as you have been unable to provide proof of purchase for the day inquestion and the CPCN still stands.
As we have extensively investigated this CPCN and provided you the results of our investigation, no futher investigation will be taken.
You now have a number of options to choose:
1. Pay the £60 within 14 days to .....
2. Make an appeal to POPLA within 28days verification code is given.......
3. If you do nothing we will seek to recover the monies via debt recovery.....
4. Supply copies of your receipts for the day in question or your bank statement with your private details errased showing transactions on our clients site with 14days.
"
My wife has sent in a bank statement, was this what we should have done?

Yep, see what comes back.
If they still refuse to cancel, based on either a lack of spend (i.e. lower than a prescribed amount) or just by making you jump through unnecessary hoops, this becomes a 'secret clause' that was not made clear in their signage. A weighty point to make to POPLA
....... alongside GPEOL, proprietary interest in the land and lack of contract with landowner. As well as chucking in ANPR accuracy and maintenance, business rates and punitive penalty.
Plenty going for you, if you play it right with ongoing advice from regulars here.
BUT - don't lose sight of the POPLA code deadline, start preparing your draft and get it up here for critique to ensure you have a winning appeal.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

We have the POPLA code, I'm away at work and my wife has already sent the bank statement and told me after she sent it before I could check on here!

Use a properly constructed POPLA appeal from a successful one on here. Post it up for checking first though.

I won all four of my G24s at the soft appeal stage but my colleague who only received one NTK, is at the popla stage.
The replies I received to my soft appeal were badly written, had totally irrelevant cases quoted and gave me the impression that the lovely Mr Spicer was making things up as he went along.0 -
Just to let you guys know after my wife posted her bank statement showing purchase(s) the charges were officially dropped.
