Neither Samsung nor p4u have an obligation to give you a replacement. Both can prefer to repair the handset.
Samsung's obligations are defined by their warranty.
p4u's obligations are defined by SoGA.
IMO warranty is more difficult to enforce if Samsung fob you off.
p4u's obligations are likely to end if Samsung decide to offer you a replacement.

Hi this is quite a well known problem with the 4.3 update which Samsung are aware of so will hopefully get fixed soon.
