'Final Letter Before Court Action' - B P Collins for CPS

Hello forum
A little help if I may. I have received a 'final letter before court action' from B P Collins LLP solicitors on behalf of their client Combined Parking Solutions Limited. I had ignored and shredded all other letters to date as I have on occasion in the past with other PPC claims. This one however seems to be going a little too far for comfort.
The letter is identical to that received by DeepInDebt on the thread "BP Collins Part 2" (I'm not allowed to post links apparently).
In any case, I was not the driver of the vehicle during the alleged parking incident, so reading the stickies on the forum I assume my course of action should be to write back to them with the standard letter identifying the driver and then defend from there? (driver was actually a time strapped GP on a home visit)
I note that the advice is to send directly to the PPC but the letter states their address as 'c/o this firm' and I do not have their address elsewhere - so assume I should send to B P Collins?
Advice appreciated.
thanks

Did they offer you a reduced settlement?
To be honest, I've read the procedure to follow, but for the sake of £60, I'm not sure I can be arsed...and this is where they win sadly.0 -

It's a very simple procedure from your point of view as you weren't the driver. Under the Protection of Freedoms Act 2012, you are being pursued as the RK because the PPC doesn't know who the driver was.
All you need to do is to write to the PPC and give them the name and address of the driver, you will have discharged any obligations on you, in line with PoFA, and you can put this all to bed.
The driver will then receive the paperwork, the clock is reset and he can go through the appeals process, to include POPLA.
You can name the driver at any time, up until actual court papers are served on you. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I would act fast naming the driver
This Is perkys outfit and they are known to do courtProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
And when you do name the driver send it with proof of postage from the post office, and send it via email as well. Then ask the driver to come here for helpWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

If the other party refuses to sign for it then recorded is pointless. Proof of posting would actually be BETTER, because the letter would be deemed received regardless of whether or not the other party acknowledges.0 -
And no doubt perky has already read this thread, so would expect this letter so won't sign for it. I would just get proof of postage onlyWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Stick a pie label on the outside...... And with this outfit it's Worth paying for it to be recordedProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -

If you definitely want to send it recorded, then write on the outside "Payment included" and then they will sign for it.
Inside, "Sorry - I changed my mind".
But I would agree with previous post from Stroma.0 -

Jeez, IMHO if you pay your silly fake PCN you are letting Sussex down!
Your case is from pathetic, laughable UKPC, a different outfit who NEVER try court! Dare I suggest, grow a pair please and ignore UKPC if you don't want to invest time on your scam. Your case will NOT end up in court and is unlike Combined Parking Solutions case in so many ways; you don't even HAVE to do anything re UKPC!kirkbyinfurnesslad wrote: »I would act fast naming the driver

Why are we suggesting naming the driver which hand CPS a simpler court case? Unless there was never a Notice to Driver, and we don't know that do we?
CPS will very likely try a small claim on this one so we need to know if the first ticket was on the windscreen or sent by post to the keeper. The OP should also be aware that 'no pre-estimate of loss' won't be a winning defence point v CPS as they word their signs as a contractually agreed charge, not as damages for breach.
Also the OP should consider whether he as keeper is happier to handle a small claim defence or the driver, how closely-related is the driver, who would not handle it as well as the other? All worth consideration but it is important to know about the PCN served. Pleasetell us if the first PCN was sent by post in the first instance or not. If it was then yes, name the driver (so that they can be sent a Notice for the first time and can appeal from scratch) and follow the example letter in ordinaryJoe's thread by zzzLazyDaisy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
