Parking Charge Notice | TPS Parking

I park at my college 3 days a week. In order to park in one of the eight car parks (which are never all full) I have to get a permit from reception and display it on my vehicle. Applying for a permit takes minutes and you only have to give details about your car; there are no terms or conditions which have to be signed.

I put my permit on my window as usual and went off to my class, when my class finished I went back to my car @13:20 only to find a PCN stuck to my window, my permit had fallen off my window and onto my seat! You could see the permit on my seat if you wanted to but obviously this parking attendant didn't want to see it!

I went to reception to complain about what had happened and their response was "it is out of the colleges control, it is now is the hands of TPS and we cannot do anything to help you". I was really annoyed at this point and as soon as I got home I tried to appeal the ticket online but to no avail as it was not on the system yet. I waited almost a week before it was actually on the system, when I checked the PCN number it was completely different on the ticket to what it is on the system!

I went on holiday shortly after and totally forget about the PCN. When I arrived back home I found a letter from TPS asking me for £75 and if I don't pay they will get debt collectors involved and etc..

I am a 17 year old student with very little income. Can a 17 year old go to small claims court?

Please advise me on what to do.

    Hahaha, nicely played. In delaying your appeal you have actually played this exactly right! See the top sticky thread 'newbies...have you got a private parking ticket? Read this now!' and I hope you will find the answer you are after. Shows you how to appeal with examples, and why you should always wait for the first letter to arrive - which you have done!

    Now learn how to appeal as the KEEP not the DRIVER and then about how to win at POPLA. All on the sticky thread but we will be pleased to advise you further once you've read it and started to plan your appeal for 'Round One!

    You won't be paying them any money you know - this isn't a real fine. There will be no court and POPLA is a postal process. We win 100% of these appeals. :)

  • I just arrived home today to another letter adding £35 admin fee and telling me I cannot appeal as I have run out of time! I have been very busy and have just not had the time to appeal!

    What should I do now? The invoice is now £110.

    If I speak to the principal of the college to withdraw the notice do you think TPS will let them? At the end of the day I parked on the colleges land, not TPS so if the college wanted to cancel a PCN, they could, couldn't they?

    Absolutely! What they told you before is complete tripe. You will need to be very forceful with them - no asking nicely, you must demand this is cancelled.

    At the end of the day, there is no loss to the parking company or college, so you owe no-one anything. They know this, but are blustering and bullying. And being 17, you can't have entered into any contract anyway!

    Oh, rocking a car so the permit falls off the dash is a favourite trick of PPC staff.

    A landowner should have the right to cancel any ticket on his land due to the fact only the landowner or his legally contracted and appointed agent can take court proceedings for trespass

    can I suggest you put up the date of the alleged contravention, also put up the date of any NTK or NTO and also the dates on the chase up letters too

    there has been no loss incurred by the landowner so you would have thought that the no GPEOL would apply as you definitely were not trespassing

    was this in england and wales or elsewhere ?

    Nobody has to pay to park on the college premises so there is no loss what so ever. I cannot justify how they can charge me £110 for a piece of paper which has fallen of my window.

    I have just spoken to them and they said they cannot do anything about it and even the principle has had one and she had to pay for it.

    If I cannot appeal what can I do other than pay £110?

    Well if the Notice to Keeper was dated 12/11/2013 you are still within the 28 days which the registered keeper can appeal, so TPS are talking rubbish.

    Do as C-M says, read her sticky for Newbies at the top of this forum and get that appeal in to TPS as the registered keeper.

    1) this is not a genuine pre-estimate of loss
    2) you do not have authority or contract to issue these invoices
    3) your signage is not compliant to the BPA Code of Practice

    So you are invited to cancel this charge, or supply a POPLA verification code if you reject this appeal, especially as it was previously submitted within the BPA code of practice.

    I know you are busy but what has gone wrong with your research on this forum, seeing as you are obviously still in time to appeal as keeper. As per the 'newbies, read this first!' thread. But I do need to adjust Redx's suggested letter as it's too late to appeal against the windscreen ticket (and we don't recommend that anyway!). We told you to appeal as keeper against the first letter (Notice to Keeper) not the PCN to Driver. So it needs to be sent like this, straight away to TPS:



    Dear TPS Parking

    Notice to Keeper ticket ref xxxxxxxxx vehicle registration xxxxxxx

    I am in receipt of your Notice, sent to me on 12th November as registered keeper of this vehicle. I wish to invoke your appeal process on the following points:

    1) this is clearly not a genuine pre-estimate of loss.
    2) TPS has no legal standing to make contracts with drivers nor authority from the landowner to pursue a charge in the court in your own name.
    3) your signage is not compliant to the BPA Code of Practice.
    4) If you were intending to rely upon your Notice to Keeper wording as complying with paragraph 8 of Schedule 4 of the POFA2012, it is fatally flawed.

    So you are invited to cancel this charge, or supply a POPLA verification code if you reject this appeal. I would remind you that registered keepers, as well as drivers, are entitled to appeal to POPLA and for the avoidance of doubt, the driver will not be identified in this appeals process. However, this is a formal appeal and if you fail to send me a POPLA code with any rejection letter, I will make an official complaint to the BPA Ltd as this is a sanctionable issue (as confirmed in the November 2013 POPLA newsletter). I look forward to your considered reply.

    This happened in England.

    Should I appeal online or appeal via letter to them?

    If I appeal online I have multiple options to chose from, which one should I pick? When I pick an option it makes you tell them why you chose that option.

    I was not the owner of the vehicle at the time of contravention:
    - I had sold that vehicle before that date
    - I had bought that vehicle after that date
    - I had never owned that vehicle

    - The parking contravention did not occur
    - The vehicle was taken without my consent
    - I was not the driver on the day of the contravention
    - We are a Hire Firm and have supplied details
    - The parking charge exceeded the amount stated on the signs.

    So they are asking you to fill in a form on-line? I personally dislike these kind of methods as it is hard to get an audit trail of what you have sent, though the snipping tool in Windows can capture what you have typed out.
