Morning All,

I am new to this website and have been reading various update and advise on how to appeal private Parking.

I got a parking ticket (Fine) of £60 on my windscreen on the xxxd September for parking in a space clearly allocated to my office if paid within 28days it will be £30. Please bear in mind I was driving in for the first time as I have recently passed my driving test. Previously I have always gone on public transport so had no space allocated to me but entitled to a space as a permanent staff. I was given a parking permit (Pass) by my office that same day but allocated to another car park in another building. After work, I saw the parking ticket by CPP on my windscreen and waited for NTK which arrived on xx Although date of postage was xx

I read instruction on the site and replied on the xxx as highlighted below:


Dear Sir / Madam,

I am writing to you regarding your civil car parking notification charge Ref: CPN xxxxxx issued to vehicle xxxxx on xx /2013. Your charge is punitive and unenforceable.

I require you toeither cancel the charge or provide me with a POPLA code so that I can referthe matter to POPLA.

I got a response back from them on xxxx13 dated 14/11/13 with the details below:

Thank you for your recent correspondence regarding the above Civil Parking Notice. I have considered the case carefully and have decided to reject your appeal on the following gounds:

Unfortunately we are unable to progress your appeal further at present, as you are a third party making the appeal on behalf of another driver.

Like many other business sectors, due to conditions imposed by Data Protection Act we are prevented from disclosing or discussing information or issues with a third party such as yourself concerning an individual driver relating to the issue of a Civil parking Notice.

We can however progress an appeal once we are in receipt of a signed and dated written consent from the driver of the vehicle at the time of the issue of the civil parking notice which gives you full authority to act on their behalf and to receive any relevant information or data relating to them. This will need to include their full name and a serviceable address.

You will appreciate the disclosure. discussion or exchange of information or data relating to individual is a very sensitive issue these days and as such should not be divulged or discussed unless express consent by that individual is given. We look forward to receiving such consent by return enabling us to progress this particular appeal for review and action.

If you are unable to divulge the above information, payment of £30.00 for the above notice can be made by one of the below options.

yours sincerely CPP (No signature)


I am a bit shaky as previous post do not have this: Please help as I think I might be running out of time.

    Dear CPP,

    Re PCN xxxxxxx - you issued a Notice to Keeper to me, I responded as keeper. Issue my POPLA code. No further correspondence will be entered into on this matter without the POPLA code.

    I will also be reporting your disregard of the obligations you have under POFA 2012 to both the BPA and the DVLA.

    send copies (again writing in the 3rd person) to the email addresses for BPA and DVLA provided on other threads and I'm sure in the stickys.
  • Write back to them saying you are the registered keeper so the DPA does not apply. Tell them unless they supply a POPLA code you will consider the matter closed.

    How do they know from your appeal that it concerns another driver? Your appeal doesn't say so.

    Data Protection, my hole. Always a convenient cop out. You are equally not obliged to discuss information or issues with a third party such as a PPC, concerning an individual driver....

    Can someone please confirm if I still have enough time to get a POPLA code for this? Do I reply them or wait for sometime before putting my response to them in a post? ( Please see highlighted drafted response above)

    You appealed in time so you are in time to be given a POPLA code. Respond with that letter, and report them to the BPA and DVLA immediately. The email addresses for the BPA and DVLA, to report this farce (but write only as KEEPER) are in this sticky thread at the top of the forum:

    If you have not sent it, I would suggest that it is slightly debatable as to whether you have appealed on any point as such. I believe the BPA would contend as much as they have done before.

    It would do no harm to cut off any dispute on that point by saying that your vehicle had a permit and it was parked in a company slot. To my mind that is a valid point.

    You can also refer them to the BPA CoP section 22 that clearly states keepers can appeal

    22.4 If a driver or keeper challenges a parking charge you must
    review the case and decide whether to:
    • uphold the parking charge and explain why it was
    issued and should therefore be paid, or
    • reduce or cancel the charge and take no further
    management action other than informing the drive


    POPLA (Parking On Private Land Appeals)
    22.14 Drivers and keepers may appeal against a parking charge
    to POPLA.

    @ Guys Dad, thanks for your input/advise. Unfortunately I had posted my response to them before seeing this, wish I had seen this earlier to buttress my point.

    Also @ Coupon-mad & martmonk there seems to be no template to report to BPA and DVLA in the sticky's apart from the 2 email addresses compiled. Do I write explaining the facts to them in my own words or wait for the POPLA appeal before putting the facts together? I just want to be sure I get everything right on this as I was issued 2 fake tickets in a week (I will be creating another thread for 2nd one soon)

    No worry. If they don't supply the POPLA cose - and that's what it is all about - then you just go back with some other points and eventually they have to supply one.

    When it comes to the POPLA appeal, do read up on a few on here and come back before sending it off.

    That's because we need people to write an email in their own words or the whole thing looks spoon-fed by the forums! Personally I HATE TEMPLATES and think kids should learn to write a letter at school these days, like. And I work in a school myself! :)

    A complaint about a PPC not keeping to the POFA 2012 or BPA CoP is just a couple of sentences with some attachments of the letter(s) that have been received by the keeper, not giving away who was driving, not referring to the parking event nor talking about any windscreen ticket.
