Yes, main motive is probably the principle and the fact that I can't let things like this go ;)
Then instruct your solicitor to pursue this.

You may need topay additional legal fees for him to pursue the costof the 2nd hand washing machine, which, if you aresuccessful, you can also claim back from the vendors.

And if in the process it transpires that the vendors solicitors can prove they sent the amended f&f list to your solicitor, then you'll have a claim against him.
  • Yes, but my instinct is telling me it was not faulty and they are trying to pull a fast one.

As said earlier, with installation cost for the new machine it has cost me around £600. That is £600 I would rather not have spent and if I can recover it, I will.

But the point is that you wouldn't stand any chance of recovering all or even most of this, even if you managed to put together a cast-iron case. You will at most be deemed to have lost the value of the old (and as the vendor argues, faulty) appliance. I highly doubt it will be worth the hassle...
  • Thanks for everyone's advice!

I have since replied to say that regardless of the fact, I was never informed and nor was I presented with a revised f&f list (I may have adjusted my offer accordingly otherwise), so I will still be taking the matter to court to recover the cost of purchasing and installing the new machine (which has now been fitted today)

    Seriously???

I think you need to chill out a bit. New washing machine £300. Secondhand one from ebay? £50

You wouldn't have adjusted your offer and you will look like a **** if you go to court
  • Great post Talc, very informative.
  • As a vendor if someone wanted to reduce offer due to washing machine I'd decline x
  • it is the OP's decision whether it is worth the effort. Personally I would be feeling I have been robbed and would want some action taken.

  • Thanks BornAtTheRightTime. That is exactly how I feel.

I wasn't really after a debate about what people would do - I just wanted to know where I stood legally with the signed fixtures and fittings list not being kept to.
  • Just imagine for a moment that the vendor was being honest about it being faulty then to solve this legally would the vendor not just drop off a broken washing machine to you?
