Virgin Flight Delay 2010

My flight was delayed back on 15/5/2010 it set of late therefore arrived at London Gatwick 5 hours and 2 minutes late.
My claim was rejected on the basis of no 16 medical grounds extraordinary circumstances- the plane had to be diverted en-route to Gatwick due to a medical emergency previous. Therefore it arrived late at Gatwick, took of late, so got to Montego bay late so we were late leaving.
I am trying to sift through all the info and faqs, just wondering if I could proceed to the next step or not.
Any links would be greatly appreciated.

Medical emergency is not the airline's fault, there would be nothing in their control they could do to have avoided this.

If you don't feel willing or able to read through comprehensive guidance and links in the FAQs, you should consider engaging a no win no fee lawyer.
Also, it's helpful if you could post on the Virgin thread.Medical emergency is not the airline's fault, there would be nothing in their control they could do to have avoided this.

I agree that a medical emergency is outside the airline's control (and does give the airline a better starting point for a defence than, say, a technical problem). However, that is not the only or decisive test in determining whether compensation is due.0 -
If I understand correctly, was the medical emergency an issue on the plane two flights prior to your own? Ie the original inbound flight to Gatwick delayed due to medical emergency, followed by a flight to Montego Bay, followed by your flight from Montego bay back to Gatwick?0

Yes this is right, the plane to 2 flights back was had the emergency. As they used the same plane mine was consequently delayed so arrived 5 hours late. I thought id have a claim on this basis since they knew on the Friday my Sunday flight would be late.0 -

That definitely sounds as if, however exceptional the medical emergency might be, they did not try hard enough to manage the impact. 48 hours must be entirely unreasonable, I would have thought.0
