Hi All
I received a £100 fine for overstaying by 14mins in a car park outside my house (there were no other spaces) from Armtrac.
I must appeal within 28days and the NtK will take 28days +, surely I'll have to appeal first? Or I'll miss the appeal deadline and not get a POPLA code?
I'm thinking of submitting a similar letter to those which have worked in the past any thoughts?
They also state you must provide the name and address of driver if different from keeper - how do I challenge this?

As this is a ticket on car you should wait for the NtK to arrive, it must be with you between days 29-56 after parking.
And if they are saying you must name the driver then that is a lie and a breach, forward that letter to the bpa and dvla, say you are the RK of the vehicle don't mention who the driver is.
Make complaints on that this can be dealt with as the RK as that is what pofa 2012 is all about

Ok thanks. I'm still unclear on waiting for the NtK even having read the forums Armtrac say
"If you wish to appeal against this Parking charge Notice you should submit your case in writing or email (address on front of Notice) within 28days from the date of issue. All correspondence must include your name, address, the name and address of the driver (if different), vehicle registration and Notice reference number...."
Does this mean after receiving the NtK, i.e. over 28days I can still make a 'soft' appeal.
This is my second dispute with Armtrac and they previously emailed me back saying I must name the driver before the case was heard - do I submit this in my POPLA appeal?

Right, there are two appeal chances (England/Wales) and unless it's a hire/company car, your case is stronger as KEEPER NOT DRIVER, at the 2nd chance stage:
- the ticket on the windscreen gives the driver their chance to appeal. Appeal as driver? DON'T!
- the notice to keeper (first letter next month) gives the owner/keeper their chance to appeal even if it's a rubbish formal demand letter. Appeal as keeper? YES!

Just read 'newbies...read this now!' because it's all covered there already. I wouldn't bother yet to report them to the BPA and DVLA as I expect there will be more wrong with the first letter and you could complain about the whole shebang later.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You may well receive one. However, it will be too late for them to invoke Keeper Liability under PoFA.
The other option is that you eventually get a Debt Collector letter. They will claim they sent out an NtK. The will be lying.0
