So, I have 2 tickets in 3 days from Car Parking Partnership.
Hand written, usual envelopes same old same old!
I've decided I am going to ignore these little scraps of meaningless paper deposited onto my windscreen and any other paper wastage sent to me through the post concerning them, HOWEVER, feel I must start to gain some all important information if, for instance, if I am taken to court in future, by these money making racketeers.


The "actual" sign on the wall referring to the parking has very small lettering and is unreadable whilst entering the area.
It reads.

PERMIT HOLDERS ONLY.
Private Land- no public right of way (section 31 (1) of the highways act.
Failure to display a valid permit or to comply with the conditions of your parking permit will result in a parking charge of £80 payable within 28 days (reduced to £40 if paid within 14 days).
Restrictions apply at all times: blue badge holders are not exempt.
In the event that the parking charge remains unpaid after 28 days we may request details of the registered keeper from the DVLA.
Unpaid parking charges will be sent to a debt collection agency and further costs may be incurred.
The driver by entering and parking the vehicle on the property has agreed to the terms and conditions above.

So the CPP are acting as an "agent" for the landowner.......
My question is does anyone on the forum have any legal knowledge of the section 31(1) highways act and HOW this can be used as a way of ticketing cars?
I am not a lawyer but if the place where I parked is "Private" then how could it possibly be a highway as well? From my understanding of the highways clause it IS a highway! So I don't understand what BYLAW? I have actually broken?
Please, if someone could help me on this I would greatly appreciate some help......
I have also inquired about the possibility of getting a permit for said area, but have serious reason to believe that permits do not even exist to park where I did, but I may get an answer tomorrow about that.

    You misunderstand - the reference is in support of their confirmation the land is not public (or part of any Highway). Use of irrelevances that sound 'official' are a very common ploy, generating the fear in the recipient that they should quickly pay up.

    Thanks for your reply.....but still don't understand what you mean.....
    The land is either private OR highway, if the sign is ambiguous AND very small could this be a case for me to challenge the tickets....or as I would love to do...carry on parking there?

    What does section 31(1) of the highways act actually mean?
