Sports space Hemel POPLA received

I need help, so I've read many of the threads here but need some advice before I proceed.
I have already challenged a penalty notice prior to coming to this site having thought I had evidence I used the car park to take my son swimming and this would be the end of the issue.
I have now had a response stating that I didn't register my car to receive the free 3 hours I would have been entitled to if I had. Although I didn't raise it in the original challenge I think I did but the vehicle is new to me and I may have entered the reg incorrectly.
Their wording: It is the drivers responsibility to adhere to the parking terms.
Do I have a case to continue the challenge, I used the car park to use the facilities and have the receipts to prove it, is the reduced charge of £75 if paid within 14 days fair for less than an hour which would be free should the vehicle have been registered correctly?
They have supplied my with a POPLA
I've not seen any examples that are similar cases any advise would be greatly appreciated thanks.

You dont need any "similar" cases at all.
Look for genuine pre estimate of loss and no contract, thats all you need to concentrate, draft up your popla appeal before you submit
What happened on the day is completely irrelevant in terms of popla.
Read of a couple of the last few pages, that should provide u with enough guidance

Here's two links with some excellent advice/examples on what a good POPLA appeal should look like.

Have a read through them and mould your specific circumstances around them. But don't bother with any of the 'what happened' (mitigation), other than an opening scene setting sentence or two, as it will not be of any consequence in the appeal adjudication.
HTHPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You have probably paid your fair share in council tax to be able to park there free for life anyway!
Whilst constructing your popla appeal, take half an hour to go down the Civic Centre and demand that they quash the charge on your behalf. The sports centre belongs to us as we paid for it (idealistic, I know) and as a genuine customer, you shouldn't have to put up this sort of ****
By the way, are they still charging £150 as the full charge there?0 -
More POPLA 'how to win' links were there all the time in 'newbies, read this first!' sticky near the top of the forum as you went to start your thread:
http://forums.moneysavingexpert.com/forumdisplay.php?f=163
As others have said you don't need 'your sort of case' but having said that, you would find cases like yours on here if you searched the keyword 'gym' or 'Hemel' (easy when you know how to search and it's on the link above too, first page). But IMHO that's a waste of time because yours is no different than any other case and you need instead to learn about POPLA winning words. After reading the POPLA decisions (latest posts) and 'how to win at POPLA' linked on the sticky thread I mentioned, please show us your draft here first as we want to help you win.
You'd lose at POPLA if you appealed about whether or not you put the car reg in correctly.
You will win if you send our sort of POPLA appeal - but can we just check who the PPC is - I think from a quick search that it's still Civil Enforcement, am I right? And how much is the PCN and does the first Notice say you 'breached' terms & conditions please? Did you get a windscreen ticket or just a postal one? Dates?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you can not drop the emotive "having your say" bit, then you will lose your POPLA appeal.
Popla have backed themselves in to a "legal corner" use the proven points to corner them and win.
This is no place for emotions or opinions, you need direct unclouded technical points and stick firmly to the proven ones.Be happy...;)0 -
Thank you all for your replies.
In not sure of the original wording as the letter is at work but I will check I have been given an additional 14days to pay at the reduced rate and yes I believe the original charge is £150.
Not bothered about putting my story across just not wanting to pay for something I feel is unfair.
Yes Coupon-mad the ppc is Civil Enforcement Ltd and it was a postal ticket.0 -
You dont need to check the original wording, nor worry about the amount to pay etc
Just follow the advice given and forumulate your popla appeal.
Then post it up hereProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
So it's civil enforcement then, was it before 1st November then parking incident? When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Yes October why?
I've also noticed the there is 20 days between the date I parked and the date on the original letter from what I have read this is outside the 14 day rule?0 -
Civil Enforcement were issuing £150 tickets up to the end of October even though they did not have BPA authority to exceed the £100 maximum in the BPA Code of Practice. It's one of many appeal points you can add into a typical POPLA appeal. Use one of the examples we've shown you, as a base, then add stuff to it. Show us your draft and we will help you.
And re the 14 days - the most important question about dates is, was it sent by day 14?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
