T-Mobile sent out a used phone

Not sure where I stand with this or how to deal with it. In April I had a phone upgrade, the iphone came but after 48hrs messing about T-Mobile agreed it was faulty. They sent out another phone which was not in its original box, no other items or paperwork came with it. After calling them they reassured me it was a "new" phone but what they call quality check ( a phone they picked out to be quality checked) and assured me it had never been used and was not reconditioned.
The phone started playing up again and I was told I had to take it to a Apple store which I have done. The man explained that due to its age the battery needed to be replaced, & a faulty switch I told him it was just over 6 months old. It turns out my "new" phone was second hand and was reg in Dec 2012 and was a reconditioned phone which had been returned as it was faulty.
The Apple shop have replaced my phone but am not happy with T-Mobile for the customer service as they have lied.

This sounds to me like a breach of Regulation 5 of the Consumer Protection from Unfair Trading Regulations 2008. You should also ascertain whether the replacement given to you by Apple (as T-Mobile's repair agent under Section 11N of the Supply of Goods and Services Act 1982) is new or reconditioned. If it is reconditioned, its parts will have been used previously and will consequently have a shorter remaining lifespan than those in a brand new iPhone. You should seek compensation from T-Mobile for this inferior quality product or demand a replacement.0
