JSA predicament ??

Hello,

First time poster, and I'm looking for a little impartial advice.

I left my old job a few months ago because I believed I had another Job to go which fell through. Without having a contract or anything hard in writing, I quit my old job which yes was foolish I now appreciate however I was deeply unhappy there and jumped the gun at the prospect of something else. I applied for JSA, well prepared I might not be entitled to it initially as I left my old job.

I explained that I left as I thought I had a new job, providing what few details I had. I was granted JSA and been receiving it the past 2 months. Today however I've received a latter stating more info is required as to the job I believed I had secured, and also that my old employee wasn't sure why I left, saying I gave no reason (were they allowed to contact my old employer with out my authorisation?). I'll again provide this info, and maybe I should contact my old employer also (embarrassingly) in case there contacted again. However, I am wondering if it is now (2+ months later) deemed I left my job without good reason, can the sanction apply to my back dated JSA received already and I'll have to pay it back??

Now, to complicate things even further I have a job interview later this week which I am fairly confident I'll get (I know the interviewer and I'm being given helpful direction). If I receive this job, do I still have to provide this info etc. whilst being signed off JSA, and less importantly, how and when do you sign off from receiving JSA when you have secured a job??

    It's standard to contact your last employer when claiming JSA to check that they agree with your reason for leaving before deciding on whether a sanction is appropriate.

    When you start a new job you contact the job centre either in person, by phone or return the booklet you have. Do not do this until the day before you actually start.

  • You may get sanctioned but if so you should appeal the decision. I am not sure about the rules when a job offer falls through but you can see about that if you need them to reconsider. If they paid benefit when they shouldn't have it may come down to their error, in which case they won't seek repayment.


    You may technically not be required to tell Jobcentre where you are working, but in practice I don't know if they would need to pass on a P45 or whatever to the new employer.
  • DWP should send any P45 u to the claimant - it has nothing to do with a new employer other than to provide the tax code and more up to date income details.

    Sounds easy enough to 'sign off', glad it won't involve another trip to the JC (I've got two visits this week). Here is hoping I get this job tomo.

    When I left, I did not have anything in writing regarding the new job that fell through. It was via a recruitment agency, I was told they were very pleased with me and when could i start, i needed an excuse to leave my previous hellish job and this was it (I appreciate I. Add a mistake here). I provided this info at time of application for JSA, however now almost 2 months later I have this form wondering all the details/contact info of the job I believed i had, why I told my old employer I was going abroad (not sure where they got that from, I was going on holiday but informed I was leaving for another job), and why there was a gap between leaving my old employer and signing on to JSA. I guess I'll just fill it in as best as I can, hopefully they won't contact my old employer (again) to say that the reason they've gave for my leaving I've said is incorrect, although I understand if they need to contact the recruitment agency / job that fell through.

    Also, looking at this letter which I received only yesterday it says it needs to be in by tomorrow (week from the printed date), they sure give short time windows. If it's not received by tomorrow will they immediately sanction (stop) my JSA?

    I'm sure they'll want some proof of this job offer or else everybody would be able to use this as a way of avoiding sanctions for leaving a job voluntarily.
  • They will not get much proof unfortunately, I guess this will lead to a sanction? However, all going well, I'll be signing off this or next week (hopefully). So wondering if it's worth even sending this form in for a sanction against my name??

    I think you should stop jumping the gun. You are "hopefully" signing off - so you haven't actually got a job? That is what landed you here in the first place - nobody offered you a job, they said you did a good interview and when could you start. Which is not an offer! Fill in the form.
