United Utilities Leakage Code of Practice

Does anyone have any experience of Unitied Utilites fixing a supply pipe?
It's been confirmed that we have a leak and they are very kindly coming to sort it out for us, but we have a slight problem.
Our drive is brick and the chap who came today said that legally they have to make the drive fit for purpose, so will tarmac over any work.
I've had a look at their code of practice which states:
We’ll provide temporary reinstatement after a repair, and leave everything neat and tidy, but it’s down to you to organise any permanent reinstatement (e.g. laying new tarmac or paving slabs).
We were hoping that they don't have to tarmac, as we will just have to remove it to re-brick, but this didn't seem to be the case according to the man who came out.
Has anyone been in a similar situation and were you able to sign some sort of disclaimer that said 'If we trip on our drive it's our own fault' ?
We can't afford to do the work ourselves and we're not in a position to ask the landlord to pay as we rent from the OHs family.

They'll repair the pipe, fill the hole in the ground and put a temporary surface of tarmac down.
If you insist that they don't put the tarmac in, and you sign something to say that's OK, then I suppose they might agree. Ask them. and tell them you're happy to replace the bricks.0
