Hello All
I am stack with Sony Camera (cost me £900) with inherited problem - it just does not switch on. It has been in repair with "old" jessops twice in two years. This time when I contacted new Jessops they said they had nothing to do with it as they were Jessops Europe.
I contacted Sony, they brushed me off as they said they only provide 1 year warranty. I pointed that that was an inherited problem and it has been repaired for the same problem when it still was under a warranty and I mentioned Sale of Goods Act and that they suppose to deal with me for up to 6 years. They said they were very sorry but they were not able to help me.
What do I do after that? Can I take them to Small Claims Court.
If you have any information on that please help me.
Every info will be much appreciated.

Sorry for spelling and grammar mistakes

In an answer NO as you have no contract with Sony. Your contract is with the retailer you purchased this from.
You would need to contact the administrators. If you paid by credit card then then you could try a Section 750 -
Its an inherent problem you mean.
What you need is an independent investigation and report, which you have to pay for, if it is found to be an inherent problem then you can deal with the manufacture and you should get the fee back. If is found to be just faulty, you , unfortunaltely will just have to suck it up unfortunately;make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
McKneff thank you for the information, could you tell me if there is a law stating what you said that I can come back to Sony with the report. I have an impression they never heard of Sale of Goods act....
I am determined to fight till the end!!! :-)0 -
Firstly, Sony owe you nothing now that the guarantee has expired.
Your only hope with Sony would be a goodwill gesture, but it seems they are not going to help you.
As the old Jessops has disappeared, you cannot use the Sale of Goods Act against them.
SoGA and six years is only against the seller, i.e. the old Jessops.
Your only hope is that you paid for the equipment using a credit card or perhaps some other form or credit agreement.
If you did use credit to make the purchase, then the credit card company are equally responsible for performance of the contract.
As such you could enforce your SoGA rights against them.
Have a read of MSE's Section 75 Refunds article for further details.
You mention an inherent (not inherited) problem.
You will probably need to prove to the CC co that the problem really is inherent, and not due to misuse, etc. You may need to get an independent report for that.
Have you seen MSE's Consumer Rights article?
Lots of good stuff in there.0 -

The manufacturer has no responsibility* for problems, inherent or otherwise, after the guarantee runs out.
*except in some cases where injury is caused.0 -
I was under impression Sale of Goods Act will save me. Do I really have to "just suck it up" :-(0

The sale of goods act covers contracts between a consumer and the retailer. The only time it will apply to the manufacturer is if the goods concerned were purchased directly from them.
One very important point mentioned earlier was regarding how you paid.
If it was with a credit card then you have "section 75" rights.
This is section 75 of the consumer credit act, and basically this states that the credit provider (card issuer) is jointly liable with the retailer for any breech of contract.
If you did pay this way then you should contact your card issuer and tell them of the problem and ask them to send you the required paperwork to enable you to open a S75 claim.0 -
What is Supply of Goods Act 1982, I just started reading it but maybe somebody can explain it to me in simple words please. Thank you :-)0

Unfortunately it is not a case for "section 75" rights :-(0

In simple words: there is no such thing.
The Supply of Goods and Services Act 1982 is to do with the supply of goods and services together.
Simply... not appropriate in your situation.
That is also explained in that Consumer Rights guide I linked to earlier.0
