  • Hi All,

I parked in an asda car park and stayed 15 mins over my allotted time as it took ages to park and I had a big shop to do.

I have had a number of letters from smart parking which have all gone to another address so only opened them recently.
I think I am on my 4th/5th and am terrified they will take me to court!?

I have read just about every single thread on here which all told me to ignore it they wont take any legal action but the letters are looking fairly serious now...the fine is at £200 and something pounds.

There have been no recent posts giving advice on what to do in this situation...Any help would be greatly appreciated ASAP.

    Thanks

What part of "A whop bop-a-lu a whop bam boo" don't you understand?

  • Firstly the newspaper needs educating in the fact they are not penalty charges and I note that the landowner quotes:
Mr Dorman brought in clampers to deal with the problem around 10 years ago but brought in new regulations in time for the opening of the Dunelm store in 2005.

It’s not about penalising shoppers – we just want to make sure there is space for them.”

Could have fooled me Mr Doorman - the best way of penalising shoppers is to employ a PPC.

Which PPC operates here Halibut? -

The drivel that some of comments made - how many of them have come from a PPC I wonder - classic comments from how they can manage car parks.

Still Halibut you are mentioned at the bottom - you could of course educate the paper with your wisdom by writing a letter regarding the issues!:)

The 'how would you feel if someone parked their car on your drive' brigade. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Anyone fancy opening a parking company in Gloucester ? Lots of mugs there who will cough up
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Wait a minute, why have they shown leniency? If they were parking in their car park and not using the store?

Because the amount bthey were claiming does not reflect the "loss" suffered by the landowner/PPC

Just caught up on those comments. Think I'll give the paper a wide berth in future. My friends and family know that if they get an unfair charge, I'll help them with it

ASDA Company policy is to inform Scam victims they Do not own their car parks and can do nothing about"fines"
As soon as they hit a "group" someone with some sympathy power, well hey the public dont like companies who pick on those who fought for freedom.

Well all of a sudden ASDA do own the car park and CAN cancel the charges.
How very odd, when even ASDA head office send out letters regularly lying about not owning or having anything to do with the car park.

Or Perhaps they dont and they were lying to the press ?

    Only ONE can be true.

First point - it's who contracted with the PPC that has the power to cancel the contract. It doesn't need to be the landowner necessarily if they have landowner consent and they have leased it.

Second point - They had better not sign any witness statements as Landowners then!

Third point - in preparation for second point above, get them to reply in writing that they are not the landowner when they turn you down.
