One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

""COMMON sense has prevailed after cars several cars belonging to people at a Remembrance service were ticketed with fines.""
Common sense would have been to not give them in the first place.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
What's with all this 'leniency' and pleading for 'clemency'.However, a scandal has been avoided after the supermarket agreed to show leniency and waive the fines.“We have apologised for this honest mistake and asked for clemency for those who were parked there for more than three hours.”
I would have thought that the former fighting men of this country would not be showing such deference to the likes of Asda and Smart Parking.
Where's Captain Mainwaring when a bit of backbone is needed? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -

THE IRONY !
ASDA Company policy is to inform Scam victims they Do not own their car parks and can do nothing about"fines"
As soon as they hit a "group" someone with some sympathy power, well hey the public dont like companies who pick on those who fought for freedom.
Well all of a sudden ASDA do own the car park and CAN cancel the charges.
How very odd, when even ASDA head office send out letters regularly lying about not owning or having anything to do with the car park.
Or Perhaps they dont and they were lying to the press ?
Only ONE can be true.Be happy...;)0 -
I went to post this, but I think you need to register.
You lot will soon change your tune when you or a family member gets a charge because you overstayed for ten minutes, perhaps because of a puncture or a slower, infirm relative. None of these or similar reasons will mitigate with a parking co nor the appeal service. It's not the desire to take the pee, it's the desire to be treated fairly. £90 for overstaying five, ten minutes, or five or ten days...how can one transgression be the same value as the other? Legally, a parking co can ONLY charge a genuine estimate of loss for breaking t&c's, due directly to the overstay, and then only if they have the legal position to do so, most do not or are unwilling to provide proof they do. Their letters often do not comply with law nor their own trade association rules and take no notice of disability as per the Equality Act. Charge someone a tenner and most will pay and learn the lesson. Charge everyone £90 no matter what the reason and it's the parking co that are taking the wee.0 -
I wonder what the planning permission for this car park states?
Would be interesting to know if the car park owners are abiding by them?
I see the PPC groupies are out in force on the comments!0
