Fraud - Baby shop gone into liquidation taking our money with it it?

    It will be different for everyone, how they funded, when, dates, amounts, etc.

    Fraud? That's for the administrators to look into and decide accordingly.

    Also if that's your facebook group, it's sailing very close to the wind of being libellous and potentially threatening to a potentially an innocent party.

    Yes i agree with the this, and i know that the lady has contacted the police for slander as some ladies have said some very nasty personal things to her, thankfully its not my group and ive not commented on it about the matter for this very reason, i understand its very sad for any business to go under for whatever reason and im sure they've not taken it lightly.

    Here is the correct advice.
    If you they are a LTD company and they have filed for administration, you are now a creditor and will have to join the queue and make a claim to the administrators appointed, they will pay the priority creditors first and if anything is left they will divide it by the low priority creditors which are customers who have made a claim .
    There is no fraud, yes they can take your money knowing they are going bust, right up until the day they cease trading.
    When you see LTD in any company name it = RISK, big risk.

    Unfortunately lessons in making advanced payments where you do not receive goods in exchange with a Limited company are learnt the hard way in life and it is usually something people learn, once bitten twice shy.
    Until then they rarely listen to advice about risks.

    Same with anyone, the size of the company makes no difference, you pay up front, if they fold you usually get nothing.

    Save up at home and go buy with cash and collect, if the company folds as they often do, you still have your cash.

    I once even knew someone paying £4k for a sofa, they hired a van to pick it up, but decided to pay, park the van in the car park, then go down town and buy some cushions and collect the sofa on return when the store had it wrapped up ready.
    On return, the national chain with shop is every town had gone bust and pulled the shutters down, they got neither the £4k or the sofa back. :(

    Doesn't matter what people think may have happened.

    Threatening people is a police matter and could lead to a criminal record. False accusations are a civil matter and could see people facing more bills with regards to that of anyone was to take it to court.

    Best advice I could give, is people stopped getting personal and making their situation worse and contact the payment provider.

    People who paid via CC will have the best chance. Paypal don't cover deposits or increments. They will cover a whole purchase within 45 days. Banks don't have to charge back card transactions made through PayPal. As the use of paypal splits the chain on payment. This is backed and confirmed by the FSA.

    Debit card chargeback.....well what people don't realise with that. Is that you only get the money back of it's there to be taken. They try and claw it back from the merchant bank. So sometimes chargeback get refused or reversed.

    Isn't it just small independants who do this payment plan thing, why don't people just put the money into a savings account.

    This implies to me that the retailer did intend to fulfil the order, but then financial issues meant he could not. If he had simply intended to take the money and run, he would not have ordered them in the first place.
  • Thanks for everyones advice :) My payment was in 3 parts so fingers crossed it gets refunded i shall be putting my money into a savings account, i was under the impression that if i left a deposit i would get it at the reduced price, once bitten twice shy i shall be buying it from John Lewis!
