Giving MORE than 30 days notice to end contract?

Hi I am hoping somebidy can help me with this.

I had a 24 month contract with 3 that ended at the end of July 2013. In March I rang up to ask about upgrades but their offers were terrible so I said I would give them notice to end the contract instead. They said I would have to pay to end the contract early but I pointed out that I was giving them 120 days notice (or thereabouts) and was happy to pay my moonthly payments until the end of July as it was less than the early redemption fee.

Fast forward a few months and I have only just noticed (I know... :doh: ) that they are still taking £20 per month out of my account. I rang them up and they said that I am only allowed to give notice between 38 and 30 days before the end of my contract. As I gave notice before that, they didn't actually cancel my contract. This seems insane and it's not actually part of the written T&Cs. The clause in states;
On 30 days’ notice, outside the Minimum Term. You can end the agreement if your Package does not contain a Minimum Term, or if you want to end the agreement at the end of your Minimum Term or any time after your Minimum Term has expired, provided you give notice to Three Customer Services at least 30 days before the date you want to end the agreement (a Cancellation Fee will not be charged).
However, I've just spent ages on the phone to somebody in India who refuses to accept that and says that as I tried to end my contract early, I should pay the Cancellation Fees. He didn't seem to understand the difference between early cancellation and early notice. Anyway, he refused to put me through to someone in charge and just said he'd send me a letter stating their position.

What can be done? I don't want to get involved in the Small Claims Court unless I have to. I'm only talking about £80 but I am loathe to just let it go on principle.

    Write to them and ask for a transcript of the call you made giving them 120 days notice. whether it is restricted to 38 days won't count if they accepted the notice without question.
