Parking eye - first letter - have receipts - pls can someone confirm something

Options
Just received the first letter from parking eye regarding an overstay (21 minutes) in a retail car park.

Although I am the registered keeper, and the letter is addressed to me, I wasn't the driver on the day.

The driver has receipts from the store, also receipts from the cafe (the cafe also had a problem on the day where the till wasn't working and the items purchased had to be hand written and totalled on a calculator - thus adding to the time).

I've read through the forum & think I know what i'm doing but just wanted to double check.

Rather than going through the 'I wasn't the driver' route or going back to the store with receipts & getting them to deal with it can I just write a letter to parking eye, along with a copy of the receipts, asking them to cancel the charge?

If so, is there a draft template/letter I could modify to my own circumstances?

Thanks in advance.

Fill in the drivers details with a serviceable address and let them worry about it.
    Be happy...;)

You can appeal this as the registered keeper if you want, don't mention who was driving at all, photocopy the receipts and tell them to cancel it. We do recommend complaints to retailers, if nobody complains then the status quo continues

Just got off the phone with the deputy manager of the store (having been passed around first) - they have said i should send a letter of appeal but also bring the receipts in to them and they will send an email to parking eye.

I dont want the hassle of taking the receipts into the store because it's not a local store and i've got better things to do.

So should the letter simply state that i am appealing because i'm the registered keeper (do I not say that it wasn't me driving?), here are copies of the receipts (should I go into the 'tills broken saga?), please confirm you will cancel the charge.

    Is that it ?

    Thanks again.

Email the complaint to their head office and attach the images of any receipts

So would you not even bother contacting parking eye?

What if I don't get a response before the initial 14 days are up?

In the meantime i've been drafting a letter to parking eye - so would you hold off sending this or do both (ie send the e-mail with images to store head office and send letter to parking eye?)

You do both, don't wait on the whim of the retailer

Thanks, scanning the images as I type.

Would you mind casting an eye on the letter i've drafted (i've based it around one I found on the forum)?

Thanks, here it is. I've also got an email ready for the store's head office along with a copy of this letter (when finalised) and scans of the receipts.

    16th November 2013

    Dear Parking Eye,

    Parking charge notice dated XXXXXX
    Your Ref – XXXXXXXXX.

Enclosed are copies of receipts for items purchased on the day of the event (XXXXX) to verify genuine purchases from the business in question.
As the registered keeper I am inviting you to uphold this appeal and cancel this charge (Your Ref – XXXXXX) with immediate effect; complaints have already been made to the store.
A reply is expected within 35 days of the date of issue of this letter confirming the cancellation of this charge.
If you reject this cancellation request please provide within 35 days a POPLA verification code to allow an independent appeal, as per the BPA Code of Practice, where this unenforceable charge will be strongly challenged.
I reserve the right to research and raise any further areas of appeal that may come to my attention in the meantime.

    Regards,

If you reject this cancellation request please provide within 35 days a POPLA verification code to allow an independent appeal, as per the BPA Code of Practice.

If this does go to Popla there will other grounds of appeal like, no genuine pre-estimate of loss, no contract to issue invoices, no adequate signage & no grace period to leave the site. As you know these will be upheld there.

I look forward to the cancellation from you
