UKCPS Parking Charge Notice appeal or ignore?

Hi all.
I would like to ask you what to do in this situation, as the stuff I read at the forum indicates that is best to ignore it though there was a guy who recently got summoned to the court in one of the threads.

In my situation, it happen in Wales, I had trouble finding a place, at the UKCPS parking, to park at first though I found one which was not marked in any way and it was very dark already in this spot. It was so dark that the ticket-giving-guy didn't see the colour of my car right.

Should I leave it and wait how it develops or should I appeal straight away?

Thanks in advance.

Just what are you reading?? Nothing from the last 6 months that's for sure.

    1. Read this helpful guide first https://forums.moneysavingexpert.com/discussion/4816822

    2. Read 6 threads from this page - ANY 6.!!

That will answer your question in the heading.

Now, after reading the link I suggested, come back with some dates of event and NtK if applicable. And confirm it's not a hire or lease car.

I was referring to this thread: link...forums.moneysavingexpert.com/showthread.php?p=63272331&highlight=#post63272331
the others I read in no particular order trying to learn as much as possible not paying attention to dates of the posts. Backtracking most of them was rather old.

    This is a private car.

    The event happen last week.

Per reading what Coupon-mad and Umkomass are saying in the link you provided I should wait till I get the NtK.

I though there is a faster way of maybe even suing them for gluing some stuff to your windscreen which looks like a real thing that you can get from the council.

Also interesting to me are the details of cases that UKCPS won as they show on their site. Maybe these are similar situations to that in the link I refereed to above where the person ignored the court summon?:
    link...ukcps.net/court.php

BTW: Does anyone heard of a situation where someone won when the case was taken to court?

@Guys Dad thanks for the answer, any and all advice is much appreciated.

There are several threads where people have beat the PPCs at court, but there's no thread that combines them all.

OP - I can understand your anxiousness to get this over and done with as soon as possible, but if you rush at it you will be in a less favourable position than letting things take a more natural route.

Talking about court cases now is looking too far ahead, and is rather pointless at present.

Wait for the NtK - DO NOT contact the PPC at any time before receiving this. And note: it won't be with you for at least a month (between 29 days and 56 days from the event date is the earliest it can be served).

Meantime do plenty of research (of latest threads - do make sure you check their dates!! ) as the more you understand the process, the easier you will find it and the better your chance of a favourable result.

PS - forget about 'suing for gluing' :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

There is this thread I am keeping up to date, hidden in the WELCOME sticky thread and shows all the court wins I could think of and add:

    http://forums.moneysavingexpert.com/showpost.php?p=62971894&postcount=65

...includes UKCPS v Murphy from 2012.

But even though you have read old threads and one about someone with court papers, NONE of those are relevant to you, xemopunkx! You only had to come to page one and read the sticky threads all along!

You'll win at POPLA written appeal stage if you follow the advice given here. There will be no court for you! Wait for your Notice to Keeper.

    Hi guys.
I have complained to the management of the attended store at the Centre where I got the parking notice. They took me to the management of the Centre as they do not have anything to do with the parking.
Similarly the Centre management said. They said I should deal with the company as they work for the land owner directly.
Since they did not gave me the land owner's details I want to write a letter (outlined below) to the Centre's management which they can then pass to the land owner themselves or I will do so upon getting the land owner's contact details.
Please comment, your feedback is much appreciated.

I am writing to you asking for the details of the land owner of the ... as I wish to complain to him/her directly with regards to mistreatment experienced at the parking site of this Centre.

On the ... after attending ... and validating the parking ticket, which was received at the entrance to the car park, upon returning to the car it had a parking notice stick to the windscreen. It states that the car has no parking permit nor authority to park in the parking site. The notice number: ...

Even if the UKCPS wants to argue that the car was parked in a zone where you need a special permit they have certainly not made the driver aware of this. Even if they want to claim there were signs they possibly couldn't have been seen as in this spot was so dark that the person who gave the parking notice read the car's colour incorrectly (as per details on the notice).

The company representative showed no interest and refused to accept the complaint only suggesting to appeal to their office. This will be done if the situation is not solved beforehand.

I believe it is in your best interest to be aware of this sort of 'money extortion' actions that the UKCPS takes in your Centre as it is your business which will suffer as me, my wife & our friends stop bringing our business to the Centre until the situation is dealt with and the charge is cancelled.

I must admit that it was a good incentive to come there and not having to worry about parking fees increasing every hour, as long as you validate the ticket at the attended store. Though, if I am to pay for parking in a different place I strongly prefer this than finding the sort of 'fake invoices'.

    Best Regards, ...

That's pretty good! I would just double check it for implying who was driving (which you must avoid in all complaints and appeals). This bit suggests to me who was driving:

'Though, if I am to pay for parking in a different place I strongly prefer this than finding the sort of 'fake invoices'.'

    maybe could be

'Though, if we end up shopping elsewhere in future, even with a small parking fee, we would strongly prefer this than finding these sort of 'fake invoices' from a firm who you only have to Google to read about their terrible reputation.'

I would indeed send it to the landowner/managing agents who run the place.

Always appeal and POPLA, my converted advice now.
If nothing else you cost them £27+ VAT one PPC went to the wall this week.
All those £27 soon add up.
    Be happy...;)

Well spot I missed that one trying to apply all the advice about avoiding any indication of naming the driver.
I will double check the wording and will certainly send it.
    Thanks again.

This is interesting information to know.
Like you say even if only to cost them it is worth to go to POPLA my thinking as well :)
BTW: Could you link me to the details of their costs and POPLA? I seen people mentioning this cost on the forum though never found a link to it. I would like to read more about this.
    Thanks for that.
