    Is that meant to be an improvement? The so-called ethical Co-Op shouldn't be in bed with ANY of these completely unethical companies.

    Quite.

    The tiny saving grace (if any at all) is that Smart aren't as rabid at the far end of the process as CEL. But there'll be zillions of customers hoodwinked well before reaching that point.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    You should have complained at the Co-op or by email to the Co-op Head Office, or sent a written challenge about it to CEL, NOT BY PHONE WHERE YOU HAVE NO PROOF! Anyway:

    If it was CEL that you rang (what a waste of your time and money; this is NOT a normal nice firm who would have been in any way reasonable nor fair) then change the above advice to:


    Thirdly write the following to Civil Enforcement Ltd:

    The registered keeper or vehicle reg no: ..... confirms receipt of your letter dated ......... and denies any liability to pay the parking charge issued.

    The keeper has already contacted you, spoke to xxxx xxxxxxxx on the telehone who confirmed that your cameras were at fault and this was simply a matter of a customer visiting this site twice in one day (which is allowed). I was told the PCN was cancelled of course, by your staff member.

    Therefore please confirm by return of post that this charge has been cancelled due to your faulty ANPR system. Should this not be forthcoming then the matter will also be reported to both the BPA and the DVLA for further investigation and I will complain to the CEO of the Co-op about this ridiculous unjustified charge.
