Civil enforcement

Hi,
Sorry that this is my first post but I am in need some sensible advice.
So in early October I received a PCN from Civil Enforcement Ltd. stating that our car had been parked at our local co-op for longer than the time allowed. Now I knew that was a mistake and so I instantly rang the company and spoke to one of the advisors, during the conversation it came up that it could be double entry and that it might be the first arrival and the last departure that was being recorded and that they would investigate it.
They said they would check the cameras and call me back, which they did and confirmed it was a "double-entry" and thus they would cancel the ticket and I took the operators name and confirmed that no action was required and no fee payable. They did say they would send a confirmation letter but I need not worry.
Fast forward to today, when I received the second letter stating that my fine was still outstanding. Now I am in a quandary as the official timescale for representation has elapsed. Given that they had previously confirmed that the fine was annulled I didn't feel the need to make a written representation.
My query is where do I stand now ? I have tried to ring them again but without any reply. Can someone suggest where I go in preparation of any problems, I have contacted Popla but they are only interested if a representation has been unsuccessful which is not the case in my situation.
I do wish to email Civil Enforcements but I am not sure if there is any advice anyone could offer before I send an ill worded email. I am worried that my position is weakened due to the time for representations having passed.
Any advice from anyone? I have seen on other forums people saying ignore it but I would rather not as it is causing distress at a time when it can be ill afforded.

This is a civil matter so to get any money off you they would need to make a claim for it, and as you have a defence they won't win it. I would write a firm, perhaps slightly impolite, letter or email pointing this out to them.0

thank you for the swift reply. My concern is that I know a lot of advice is to ignore the letters, they cause distress for family and so would like to just have it ended. I was going to email to request that they cancel the letter or send me a popla code? would this be reasonable?0

OK - here's what you should do:
Contact the CO-OP again and inform them that you are still receiving letters from their car parking management agents demanding payment. Remind them that this was a case of double-dipping and that you are becoming extremely upset as you are a valued customer and feel aggrieved that the matter has not yet been resolved. Ask them this time to confirm this by email or in writing to you of the cancellation and state that you will consider taking this to head office.

Secondly we need the following information from you:
Date of the alleged parking event.
Date you received the first letter - notice to keeper.
Where do you live? England/wales or Scotland NI?
Was the registered keeper the driver on the day?

Thirdly write the following to Civil Enforcement Ltd:
The registered keeper or vehicle reg no: ..... confirms receipt of your letter dated ......... and denies any liability to pay the parking charge issued.
The keeper appeals this charge and would be confident of winning at POPLA (if you would care to provide a code), as the principal landowner has already confirmed that this is a case of double dipping and has instructed you to cancel this charge.
Therefore please confirm by return of post that this charge has been cancelled due to your faulty ANPR system. Should this not be forthcoming then the matter will also be reported to both the BPA and the DVLA for further investigation.

Don't use the term 'double dipping' as that has no meaning outside this and other forums , just explain that two visits were made, and the first entry and last exit has been used, and that you put it to them that their cameras and systems are faulty.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

My understanding is that the Co-op have sacked CEL and signed up with Smart Parking.
It may be that CEL are deliberately ignoring any past requests for cancellation and 'milking the cow' for all its remaining worth. Seems to fit the business model!
OP - continue as advised in previous posts above though.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
