Parking eye, court papers here, I messed up.

    The point being I had shown you a link full of proof that complaints can get these claims cancelled if you are assertive enough, even after court papers. It's not about 'appealing' it's not about 'seeing if'...it's about a very angry complaint to PALS because you have court papers from a random third party and do the Hospital actually think that is OK?!! Had you read the cancelled cases on the link which said in red 'Parking Eye (after court papers issued) surely those threads filled you with confidence & information?

    And before that, hoohoo had given you a full reply about recent wins and the background behind them and you said

    Proactive people get their cases stopped. They are aggressive so you must match that - don't sit back and wait. Being proactive and assertive can work:

    Just a selection from the loads of updates to the zillions of other cases on pepipoo forum which you could also learn so much from just reading other threads. There is lots you could be doing to be proactive and get this stopped like in socky's case and Enfield Shopper in those links - or to add to your defence if the court allow.

    If you get a witness statement, Parking Prankster is collecting them as there are irregularities - as you'll read on those links.

    Right well I have compiled a defense using the link from above at
    suggested popla appeals written by Guys Dad
    Not sure what to do with it though? e.g. do I send it somewhere now or wait for further info from the courts.
    Emailed the PALS team using the template from
    the pepipoo website you provided yourself (welcome break template)

    I am currently trying to find out where I can send a message to the trust HQ using the template provided here in post #10

    Can you post up your defence , can't see any reason not too as they monitor this forum, they know you are and ultimately get to see it in any case
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Sorry for the double post as I wanted to make sure I am getting this across as it seems to be an important point. I replied to the court papers online but the defense I used wasn't nearly as good as some of the ones I have now seen and read. I cant seem to find a place where I can submit 'extra defense' as it is

    You need to adapt this to suit a COURT defence -i.e. do not blindly copy POPLA and you need to read the WHOLE thread as page 2 contains really relevant information and wording relating to ANPR the "system" Parking Eye relies upon.
    Not sure what to do with it though? e.g. do I send it somewhere now or wait for further info from the courts.
    The court papers should include information as to the dates and times when evidence is submitted and you really need to read "Traindrivers" original thread for relevant information and coupon mad's links in blue.
    I am currently trying to find out where I can send a message to the trust HQ using the template provided here in post #10
    - just google the name of the hospital and you should be able to find the health trust area it falls into and it is not a template letter but was written especially suited to your needs

    I'm almost embarrassed to post my defense now, should have asked for some advice earlier

    I herby give notice that I deny liability for the entire claim.I
    believe Parking eye are trying to impose an unlawful penalty of
    absurd amounts. I would like to note that I am not legally
    represented and I have discovered that the claimant's letter
    before action was not compliant with the practice direction on pre
    action conduct. I was not made aware of the practice direction on
    pre action conduct or made aware that the court can impose
    sanctions for failure to abide by it . Additionally the Claimant
    has not offered any ADR process as part of the pre action
    protocol. This is unreasonable as the Claimant has it's own in
    house solicitor.
    Also i have only just discovered that there is a independent
    appeals system for private tickets. When the ticket was issued I
    ignored it based on advise given by multiple solicitors on the
    BBC's Watchdog program.
    The ticket has been issued with regard to an overstay in a
    hospital car park, as most people will know when visiting
    hospitals it is of extreme unlikeliness that appointments are
    conducted on time due to the nature of what a hospital does. I
    believe that the extreme amounts claimed by parking eye do not
    adequately represent any losses caused by the overstay (which
    total
    Zero)

    Other than the first set of court papers which I responded to online and posted the defense copied in my above post I have yet to receive another letter from the courts yet, just a 'Notice to proceed' prom PE

    Those email addresses should be fine to start this complaint. BE ASSERTIVE BUT POLITE.

    Say your appointment overran or was late (no admissions about what you may have done so AMEND and DELETE a bit of your first post as PE read this forum).

    Say you feel harassed and intimidated just for attending an appointment and had no idea the hospital would employ such an aggressive agent. Parking management in a Hospital should never be about suing people! This should be a service provider (parking management) applying a sensitive and common sense approach in an environment of vulnerable/stressed patients, with appointments which can and do overrun. In a Hospital, if there has to be payment for parking (which is debateable anyway) surely there should be operatives in the car park who know about the issues and are a visible presence who can also help people to find parking spaces and allow people to get change if they have overstayed, maybe using a barrier at the exit so no-one is penalised in such a heavy-handed way.

    Instead, why have this Hospital allowed into their midst of caring for the community, the 'monster' that is Parking Eye (why didn't the Facilities Management just Google 'ParkingEye' first before committing to what is no doubt a locked-in long-term contract of terrorisation of patients? Their online reputation is truly SHOCKING). Their modus operandi involves issuing fake parking tickets by way of cameras, with no parking management agenda whatsoever, where profit is the aim and ordinary people are sued into submission. And now here you are having to defend a court claim for daring to attend an appointment?!

    Once you have sent the complaints turn back to putting more defence points together. We want you to get this cancelled. We want to help you to achieve that.
