  • According to the Which? magazine the average age of a toaster is 5 1/2 years.

    And according to many different sources, the average life expectancy in the UK is just over 80 years.
    Using your logic, this means that no one in the UK will ever die before they are 80.

    Tesco policy, according to my local store, is that out of warranty is out of warranty. One day, one week, one month - no return!

    Can I suggest to you that Tesco's policy might be "once it is out of warranty then no warranty service is available"?

    That does not mean, indeed that cannot mean, that Tesco will not entertain any complaint after a warranty has expired.

    You have a statutory right to seek a remedy for a faulty product for up to six years after the sale date.
    This applies whether a warranty exists or not. It also applies even if the warranty has expired.

    In fact, there is no way that Tesco can take that right away from you.

    Since you have mentioned Which magazine, can I please point you towards this page:
    In there you will see that they say pretty much the same thing.

    I read the same page and was quite surprised that a website such as which makes no mention as to durability and also uses the spelling "recision".

    It seems the knowledge base at which? has severely declined over the years. I remember it providing much more accurate and comprehensive information (much like the old direct gov website compared to the new one!).

    I have a feeling a certain part of your post is going to be misunderstood though. Specifically....the "up to 6 years" part. :D

    OP, going in to a shop and spouting the SoGA when you have no idea what it actually entails isn't going to help your case... but at least there you have a chance that the person on the other side of the counter doesn't have much clue either.

    Coming on to a forum of people well versed in consumer rights and trying to prove the point that you know more about the law then they do... Well it was never going to bode well.

    As it stood, you were entitled to nada in the Tesco shop, and be glad you got the £10 voucher as this is more than what Tesco needed to give you.

    The Tesco employee was correct, if you had paid more, then you can expect it to last longer. That's not to say that 13 months is long enough, but it doesn't appear that you have an engineers report to back up your theory, so take your £10 and be happy you got an above and beyond service!
  • Wow, this used to be a friendly site, but recently the comments seem to be off the mark! Let me just reiterate the case. bought a toaster from Tesco; after 13 months, refuses to work. I return it to the store and was told that as it was out of warranty, there was nothing that tesco could do. I write a letter to H/O and they ring to say that they are posting off a gift card to the value of the toaster.
    Now, when I post to CONGRATULATE Tesco for their GOOD service I am vilified by you lot! I have never suggested that I have a wider knowledge of consumer law than anyone on this site.
    Today, I received the gift card from them along with a nice letter in which the Customer Services person states " I agree with you that the toaster should last longer than 13 months." I am happy with the result and I would suggest that those of you who have posted negatively should be happy for me! Somehow, I doubt this will be the end of the discussion.:)

    We are, but its a goodwill gesture they have provided and not something required by law.

    Given you posted on the consumer rights board instead of the praise/vent/warnings board, surely you can understand why the replies given have focused on your rights.

    In your OP you berated Tescos employee for not upholding your rights and implying you should've bought a more expensive model if you wanted it to last longer. Tesco were right. You have no right to a remedy until you have proved the fault is inherent. And the life expectancy can be affected by price paid - there is a basis in law confirming that.

    Or should we have left your post unchallenged so anyone else reading may mistakenly think what you said is correct?
