Finally received a cheque today for two delays with Virgin on the VS075 Manchester to Orlando flight service in July 2009 and August 2011. I had my day in court on Mon 4th November and i was successful due to the help from this forum (take a bow Lord Vauban!) and the use of Wallentin and Huzar which was copied and presented to myself and the Virgin claims manager before we entered the court.
The judge was a little prickly and ill informed in my opinion in asking the Virgin rep if he should agree with Judge Platts in his appraisal of Wallentin etc in the appeal heard between Huzar and Jet2.com. I offered that this is the latest credible ruling and therefore "current" best guidance in this area of law!
He also stated that i could only claim for myself but Virgin agreed to honour the decision for my wife and child as i would simply launch action on their behalf. I was only refunded one set of legal costs as i was unable to submit the claims together due to interest calculations and a lack of room on the initial MCOL claim form.
Further disappointment was the reduction of interest from the figure quoted on MCOL at 8% to 3%. However a wins a win so carry on all of you who are battling Virgin at the moment as you are in the right!

Yes, both cases heard at the same time albeit as separate claims on MCOL system. The judge also suggested that they could have been dealt with as one claim. It was a little confusing for him as he misreferenced the facts of each incident and the fact that Virgin had the same claim number on the front page of each claim didn't help either!

So, you could merge the two cases together, without formal application, but you couldn't claim for your wife and child, even though they was on the same booking?
