Any legal beagles on line?

Help and views needed.

I signed up to M & S energy via Quidco, after seeing their offer of £100 cash back I jumped through all the regular hoops required by both M & S and Quidco but after months of communication have been unable to get the cash back.

At the moment I am waiting to find out why the transaction was declined, but just exploring my next move.

Looking at the Which website I came across information about the Misrepresentation Act 1967, which seems to suggest that anyone offering an inducement which turns out to be untrue could have contravened this act.

Does anyone have views on this, is it worth a try?

Getting someone prosecuted for Misrepresentation will not help you get your £100.

There is a lengthy thread on the Gas & Electricity board, and this post in particular seems to show that there are delays with quidco.

By the way, I am not a legal beagle.

My understanding of the misrepresentation act seems to allow for compensation to be payable or have the contract revoked if a company is guilty.I would not want the contract to end as the deal was a good one, but I do think M &S should honour they offer.

Thanks for your links I will look them up.

The problem is that M&S did not offer you anything. M&S offered Quidco £X if they were to refer a customer to them. Quidco subsequently offered customers £100 of their referral fee when M&S paid out.

Any claim would be against Quidco as they made the offer, however they have a clause that says that if they aren't paid, you aren't paid.

If you've been hounding M&S rather than Quidco, that would explain why you're not getting anywhere.
The cashback was from Quidco, not M&S.
    1. Have you tried to Google the answer?
    2. If you were in the other person's shoes, how would you react?
    3. Do you want a quick answer or better understanding?
