My PIP decision

I got 8 points on mobility, and told not entitled to PIP because "It is medically unreasonable that this will still be present in 9 months time with appropriate management"

OK, this has actually lasted 14 months altogether, with no sign of recovery, so what makes him/her take the decision that it will be fine in 9 months??? Is this right of them to say this?

Should i appeal this decision or will they become psychics again and predict a recovery??

I am at a loss here.

  • Please do appeal and include evidence that your condition will be likely to still be present in 9 months,get a prognosis from a specialist and send it with the appeal,good luck with it,if you feel the decision is wrong you must appeal it.

    I cant get specialist reports except for the physio i see, i guess he will do. Thanks i will ask him for a statement if he has time.

  • Yes ask him but make sure he states it as specific to your own condition,a general opinion about the condition itself wont count and it needs to be personal to you,you could also try your gp if they are helpful and aware of the condition you have.

    Good idea yes, they are generalising saying it should be ok in 9 months. I will have to ask for it specific to me.

    Yes and no, achilles tendonitis when first appearing is generally diagnosed as "Will get better within 9 months to 1 year" - however, since mine has been near 15 months with no real change, that general statement does not apply to me, i am now considering private surgery as its been too long and i do not think the conventional methods are working at all.

    Their report would be correct if i had only just got tendonitis, but since i had it ages, it it not a correct statement to say about my own condition. The trick i think now will be argueing the case to a appeal panel.

    Decision maker stated they will phone me in a few days to explain their reasoning, i do not know what to say to them, i think they will be closed minded, same as appeals panel i think will be the same, or they were very crap/wrong/closed minded on my ESA appeal, which i had to take to higher tier to overturn.

    If the DM does phone you, explain as you did it to us - that your condition has already lasted 15 months and so normal 'rules' to do apply.
