Unfortunately I can't really take the credit for this, most of it is from another thread, although hopefully it will serve some purpose for others!
Just entered the POPLA code they had given me into POPLA's appeal section and it's thrown up 'number invalid' !!!!
What is best to do now? Should I request a correct code from them or just ignore them as they probably don't have a POPLA code..
Is it against BPA's code of conduct to issue false POPLA codes?

Have another try with the POPLA code. I had problems with mine earlier this week, and then I spotted that I had followed a link from the blurb on the POPLA site which took me to the 'submit evidence' page, rather than the page to submit a new appeal from scratch.
If you try again and it still does not work, you will need to ring the PPC to ask them for a working code.0 -
Yes it is a breach.
Have you used the POPLA code checked contained in the Newbie sticky thread? This will give you some idea of when it was generated. I would put money on it being generated when they sent you the original letter so it is now out of date. I would send a strongly worded letter to the company (with copies of the documents highlighting the lack of POPLA code) and the same to the BPA.0 -

Just thought I would post a Thank you to all those who helped and commented on this thread, especially Coupon-Mad.
Recently had a letter through from POPLA saying that the parking operator had been asked to cancel the ticket as they had not responded to my appeal within the set out time.
Once again, thanks for all your help and advice, greatly appreciated!

I don't see why it shouldn't always win? If the company breaks the BPA CoP their invoice is automatically invalidated, like happened with me.
I'd like to have seen UKPC try to sue me after so many massive breaches of it. I pointed it out to them in no uncertain terms, either.
The first breach was to refuse point blank to give me a popla code for both invoices and instead just issue template letters demanding the money and not even mentioning it. Oh I got referred to their douchebag debt recovery company too for one of them.

That's not the case with POPLA though. An email I received included this:
Dear Sir or Madam
You recent email has been passed to the Lead Adjudicator who has asked me to thank you but to explain POPLA provides alternative dispute resolution by way of arbitration and its decisions are confidential to the parties.

Assessors consider each appeal by making findings of fact on the basis of the evidence produced by the parties, consideration of the British Parking Association (BPA) Code of Practice and application of relevant law. However, a breach of the Code would not of itself amount to a ground of appeal and Assessors cannot consider mitigating circumstances. The former may be a matter for the BPA and the latter is a matter for the individual operator.

Well Coupon, that explains why UKPC have such a cavalier disregard for the BPA CoP. It most certainly should invalidate their invoice, otherwise what's the point of having those rules there in the first place?
