    For those applying to have stays overturned, you might find it useful to include this document from the Supreme Court. It doesn't add to what is in the public domain, but I think the seal adds quite a bit of gravitas!

    Thanks Vauban and also Bott & Co. I've already submitted my paperwork, but I'll send it to the Court Manager tomorrow and ask for the document to be added to my file ;-)

  • As an individual claimant who has received the stay request from two birds I am basically stuck on the fence at the moment awaiting to see whether the County Court at Mansfield agrees to this stay. Surely the County Courts will receive guidance as to wether this EU case holds water against the Supreme Court decision? Failing this I would assume that once one or two courts have heard cases similar to mine, that the whole pack of cards will tumble down should the decisions find in favour of the claimants. I think that this will unravel quite soon after the cases opposing stays have been heard so lets hope that this will be brought to a head in the next few weeks. Get ready for the Jet3 phoenix should this happen.

    You cant be so passive. You need to write to the court opposing the stay and explaining why. Otherwise you risk your claim sitting in limbo potentially for years. It's not clear that there is going to be any central guidance - so don't take any chances!
  • I have just received a letter from the judge at Mansfield CC ordering Bird and Bird to confirm to the court by 2pm on 17th December the anticipated time scale of the CJEU case to deliver its opinion in Van Der Lans v KLM. By this time I beleive other cases will have been heard and give guidance on the expected outcomes in the cases where stays have been challenged. As a single claimant I think it would be prudent to wait just a little while longer to see which way the tide is turning.I have not been asked to agree to this stay nor have the birds been granted one, so the ball is still up in the air so to speak. I would rather the big boys take up the initial challenges as they have the expertise, resouces and knowledge that I would be able to follow rather than lead in this instance.
  • It's your case so you should follow it up after 17th December.
  • Thats what I thought Mr Magpie, however Vauban thinks I should attack now. Even if I request the case proceed I think the Judge will still await the response from the Birds. Hence the wording of his letter.
