Thank you Daisy for the letter/post.
Do you happen to know the address for Debt Recovery Plus? I can't find it on their letters and I'm loathe to phone them.
Thanks again.
My attempt to the link did not work.

I agree entirely with the OP. I have had many fights with companies, (and landlords), where I kept a paper trail, even summaries of their telephone conversations, and they did not.
Even if it never gets to court, a fully documented case can help you if you are claiming compensation. You never know how far you can go until you go too far.0 -
Right I've read everything on here now and I will send a debt is denied letter to Newlyn, re a excel parking fine. That's all fine and I understand the process. My question is will this amount of £166 keep going up when more letters inevitably come, has anyone any experience of this. Thanks in advance0

as above, but who actually cares what figure they put on their toilet paper ?
its a notional charge, which will never see the light of day unless some foolish person pays it
ie:- its an alleged unproven debt you have not signed for , so doesnt matter if it says £166 or £16666 , its what can be enforced that counts, not what their paperwork says and DRP cannot enforce it - period0 -
Thanks bod and redex, much appreciated. I've not much experience with this but I'm learning!0

But I am now coming to the conclusion that posters should be advised to respond robustly to ANY letter from a debt collector - not just the last one that threatens court action.
Why?
1 PPCs are becoming increasingly litigious
2 Ignoring debt collector letters is likely to result in the PPC marking the motorist as an easy target and issuing an LBC
3 A significant number of posters who ignore these letters seem to go on to ignore LBCs, and only seek help when the court papers drop through the letter box, so encouraging a response now, should also result in a higher number challenging the LBC, thus giving them a better chance of avoiding court action.
In short, I think it is time for the 'hot potato' process to start at an earlier stage in the process.
I have posted a couple of letters on recent threads today, which are reposted below for ease of reference.

Dear Sirs
Parking Charge Number xxxxx
I refer to your letter of [insert date], and earlier correspondence.
Firstly, I have no intention of paying the money demanded by your client, and any court proceedings will be vigorously defended.
Second, should it be your client's intention to start court proceedings, they must provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:
http://www.justice.gov.uk/courts/pro...action_conduct
Please also note that a failure and/or refusal to comply with the Practice Direction will result in a complaint being made to the court and an application for a stay of the action and costs pursuant to the provisions of paragraph 4 of the Practice Direction on non-compliance and sanctions.
In the meantime, you should note that this charge is disputed, and you must now refer this matter back to your client and cease and desist all further contact with me. Failure to do so will result in a complaint to the Credit Services Association.
I trust that I have made myself clear.
Yours faithfully

In the meantime, and in the absence of a letter before claim, you should place a note on your file to the effect that this charge is disputed and your firm is required to cease and desist all further contact with me.
I trust that I have made myself clear, and I suggest that you take your client's further instructions.
Yours faithfully

Hello,
I'm about to use these excellent templates but noticed the links don't work - not sure if the forum trims them? In my letter should I put the full URL (had to split in 2 as it trims like in the templates above)
http://www.justice.gov.uk/courts/procedure-
rules/civil/rules/pd_pre-action_conduct
Is that OK to use and replace in the 2 templates above?
Thanks0 -
http://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct is the full link. I did this as follows for the forum:
http://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct
(For a forum post you could simply copy/paste the above line(s) and you'll have a working link).
In any letter/email you send you should use the full link, not split it.0 -
Thank you for your advice and template, Daisy. I've read through a lot of material in the last couple of hours and was reassured to find your post along with the helpful advice of many others. My letter to Debt Recovery Plus has just been printed and ready to post, thanks to the time and effort taken by you and other good people here. x0
