I did send this email earlier (at 21.25) to the enforcement email address so time will tell whether or not I receive a response tomorrow.

    Ref No: XXXXXX/XXXXXX

    Dear Sirs

I am writing with reference to the above Parking Charge Notice dated 26 October 2013 relating to Home Bargains Selby Car Park.

This morning the Assistant Store Manager of Home Bargains, Selby has contacted you to cancel this charge however when I check on your website on the payments section it still states that there is a £50 amount outstanding.

I have been unable to contact you to discuss this matter as both of the telephone numbers on your letter and website take you to an automated service and do not allow the option to speak to a real person. I tried to log onto your appeal section online to see if I could contact you this way but this is not working.

As your letter states I need to respond to you by 9 November 2013 I would request your confirmation by return email that you have received this correspondence and that you have cancelled the charge as instructed by Home Bargains.

    Thank you in anticipation.

I lodged an appeal online (this was working today) as follows:

I am the registered keeper of the above vehicle.

With reference to the above Parking Charge Notice, I wish to appeal against this charge on the basis that yesterday, 6 November 2013, your client , Home Bargains, Selby, informed me that the charge had been cancelled and therefore there is no longer any charge for you to enforce.

In any case, even if there was a charge, there is no way that it could be a genuine pre-estimate of loss, therefore it is a penalty and unenforceable.

Please therefore confirm by return that the charge has been cancelled as this is still showing as a charge on your online payment sysem. Should you refuse to do so, then please provide me with a POPLA code so I can appeal to POPLA and get them to cancel the charge instead.

A message then flashed up on the screen that PE will not respond via email but will only correspond by post and this could take up to 10 working days!

Well there is no sign that ParkingEye have cancelled the charge. I have received a reminder to pay and when I look on line they have increased the charge to be paid to £85 from £50. I have sent them 2 messages via online appeal saying that the Store had cancelled the charge and I needed their confirmation to no avail. Back in to the Store tomorrow then!

Finally following a return visit to the Store the parking charge has been removed. It says on the ParkingEye website that there is no charge to pay against my reference number although I have not yet received anything in writing.

Thank you to all of you who have taken the time to read my posts and reply and advise. It is much appreciated.
