I brought a laptop online but didnt recieve the battery

    So like with many threads here, one persons experience doesn't mean that everybody should avoid using them, as some have suggested. I would imagine they have many more satisfied customers, then non satisfied ones.

    Oh and no I don't work for Very, or in that industry at all.

    Certainly not usual practice now.

    We're sorry to hear you've had problems with returning this item however your opening post is confusing.

    If the laptop arrived with no battery we would have been able to arrange a return as soon as you called to notify us and wouldn't expect anybody to try and use any product if it was missing such a key component. The fact that you state this has been used and you have stated you are unhappy with the quality a few times on here is confusing as we're unaware how any laptop could be used without a battery. If you could let us know the make and model though we can check this for you.

    However; if this has been turned on and used it will be exempt from our returns policy (as will have been advised at point of order) and also distance selling regulations as outlined in the paragraph below:

    Exceptions to the right to cancel
    Unless the parties have agreed otherwise, the consumer will not have the right to cancel in respect of certain distance contracts. This applies to the following contracts:
    for the provision of services, if the performance of the contract has begun with the consumer's consent before the end of the cancellation period and the supplier has provided the written confirmation and additional information (including information that the cancellation rights will end as soon as performance of the contract begins);
    for the supply of goods or services which are priced according to fluctuations in the financial market and cannot be controlled by the supplier;
    for the supply of goods which by means of their nature cannot be returned (e.g. personalised goods) or are likely to deteriorate or expire rapidly (e.g. dairy products);
    for the supply of audio or video recordings or computer software which were unsealed by the consumer;
    for the supply of newspapers, periodicals or magazines; or
    for gaming, betting or lottery services.

    You may want to check your understanding Chris. A laptop can be used without the battery when connected to the mains. The exclusion you point to refers to 'computer software ... unsealed by the customer' - a laptop is hardware, not software.

    Most if not all Laptops will work fine without a battery if the power supply is connected to the mains.


    It looks like the OP was aware of this and used the laptop thinking that you would send out a battery, as you are not able to do this then surely you will allow a return.

    You also need to understand that yes the Laptop is hardware, but it will come with a Operating System (software) and various other software, so by using the laptop it has activated the OS licence and who knows if the OP has activated any of the other software on the laptop.

    The pre installed software was already 'unsealed' - the customer did not do that. It may be that the OP has used the laptop for more than a brief examination of the goods, we do not have the information to determine either way, but that does not change the fact that the Littlewoods rep has posted a load of nonsense.

    The big problem with most of the DSRs is that it has not been tested in court and until it has there will be big arguments around laptops. The DSRs are supposed to allow you the same rights as you would have in a shop. Would you be allowed to take a laptop out of its box in Argos, maybe, would you be allowed to turn it on, no.

    Maybe not in Argos, but in PC World and John Lewis I have been able to try out laptops. I do agree with you though, this is a largely untested area, and no one could foresee how a court claim would go ;)
