    The registered keeper can supply the name and serviceable address of a driver at any time up to court papers being issued. The clock is then re-set as stated so the appeals process can begin again.

    Interestingly, the driver still hasn't heard from CEL regarding the ticket? now that he's been named do they have a timeframe to get a new PCN to him instead?

    Not really, as this scenario isn't set out anywhere AFAIK because POFA was written about a keeper naming the driver but doesn't then create a deadline for what happens next. We worked it out for ourselves that, because it was a postal PCN at first (ONLY recommended where there was no windscreen ticket), the point is the driver has never yet seen the ticket and must be sent a Notice to Driver otherwise it hasn't been properly served (at all).

    Not that I expect CEL to agree but then you can complain to the BPA and DVLA about them if they still pursue the keeper.

  • As I understand it, under the terms of a Consumer Credit License a DCA has a duty to refer all challenges, disagreements etc back to the client for clarification.
    Their attitude suggests a link between DRP and PPC other than that between client & supplier/agent.
    Also, when it comes to disputes over signage there is a possible argument over "in whose opinion is signage ADEQUATE?". Who is the arbiter of the word "adequate"?
    If we are talking the PPC's opinion presumably this would mean that the number of numbskulls for whom it is inadequate in a private car park would be similar to that in a public car park run by a local authority.
    The PPC surely have to disclose such relevant info prior to any hearing and the defendant would be able to quote the result of a FOI enquiry from their local authority. I compared the two on one occasion and found a staggering 100 times more seemed miss "adequate" signs on a private car park compared to a local authority one.

    Needless to say they are not getting a brass farthing. However does anyone know the chapter and verse on this situation?

    The driver that was subsequently named has heard nothing from the PPC thus far

    Just tell them to FRO - the driver has been identified yet they are continuing the harass the keeper. Report them (again) to the Credit Services Association.

    Everyone who has posted here before knows, and the details & pics carefully collated for YEARS on the 'PPC letter chains' sticky (old pre-POFA link) tells you, what the chapter and verse is. The info is already here with photos and soooooo many threads, all the same about DRP (there are about 4 just on the first two pages right now).

    Everyone gets the same letters and there are hundreds of DRP threads to search for, read and bore yourself silly with. Start with the PPC letter chains, we don't need every DRP thread bumped every time the same old letter arrives that's already in the letter chain pics (sorry but this is repeated so often our eyes glaze over). I know it's new to you but the info about DRP and Zenith letters is here for the sake of a search and a glance at the sticky threads.

    Sorry but these DRP threads bore me senseless as you only have to search the forum for the word 'Recovery'. Please just search and read and get as bored as me about it all. The letter chain is nothing to be concerned about. You have named the driver so ignore DRP or respond again (your choice) and just read about their usual letter chain everywhere. These letters were ignored for YEARS and not much has changed. Zenith as well.
