Debt Recovery Plus Ltd Help!

Hi all,

Apparently we got a private parking ticket (company owned car) but no one remembers this and it was issued on 12th May 2013.

We received yesterday a letter from these shysters demanding £140.00 by 5th Nov (also yesterday!).

What can we do, I really don;t want to pay this as we have no knowledge of this ticket. The PPC is Civil Enforcement Ltd

    If this was apparently an ANPR ticket by post (which it will have been if it alleges an overstay), and IF it was in England/Wales and so are you:

    Write to CEL and to DRP naming the driver (name and address for service). Not sure who the driver was, no problem! Choose 'the driver' who is forum-savvy enough to follow our advice here and get the thing cancelled with a POPLA appeal. YOU???? :D

    The only reason to copy in DRP is to tell them the alleged debt is being aimed at the wrong party (the company) and under POFA 2012 now that the driver has been identified, the case MUST revert to CEL to issue the driver with a PCN. DRP must stop contacting the company now or you will report them for harassment.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Is there are thread with a simple step by step approach to getting these tickets overturned?, I am new and pretty confused by this (ANPR?). The demand letter refers to an overstay )exceeded maximum parking allowance.

    Plus do I have to mention that we have no record of receiving a ticket or just forget that and say we are naming the driver now (bearing in mind this was 12th May)?

    Your case isn't at that stage yet until the keeper names the driver and the driver then gets the PCN. Every other thread on here is about how to appeal.

  • OK, update on this.

    I received a letter from DRP dated 12th Nov. It states:

    "As per the British Parking Association's (BPA) Code of Practice, Point 22.7, the driver/keeper/hirer was allowed 28 days from the date of the PCN was issued to challenge the PCN. The time to challenge the charge has now expired and therefore access to the Independant Appeals Service (POPLA) is no longer available"

    It then blabbers on about signs being correct and as registered keeper we are liable.

    Are they right? and will we have to pay, even though we had no idea of this?

    No they are wrong. You didn't try to word it as an appeal did you? The whole point was just to give the name and address of the driver. What did you say and did you send it to both companies?

  • No, there was nothing about an appeal, here is the text of the letter:

    "I write with reference to your letter dated 22nd October 2013 regarding the above case (case number quoted above).

    We have now written to Civil Enforcement Ltd (copy letter enclosed to CEL naming driver) and confirmed to them who the driver of the car was at the time.

    We are writing to you and enclosing copy correspondence to show that this alleged debt is being aimed at the wrong party and under POFA 2012 now that the driver has been identified the case must revert to CEL.

    As such we consider our business with you concluded and expect to hear nothing further from you on this matter"

    That's it. Are the correct and if not, ideas on the next stage?

    And report DRP to the Credit Services Association for breach of the new October Code of Practice for their debt collector members. They will be one of the first complained about for breaching it I expect!
